It has been about two years since Apple last released a major firmware update for its Apple TV platform, so the release of Apple TV 3.0 today will come as welcome news to those who own the device.

Apple TV 3.0 is largely as rumored: Adding support for Internet radio, Genius Mixes, iTunes LP and iTunes Extras (bonus clips, interviews, etc.). But it boasts another new feature as well: A redesigned user interface.

Whether the debut of Apple TV 3.0 heralds a hardware refresh of the device itself is anyone’s guess. It is worth noting, though, that there’s been quite a bit of speculation recently that Cupertino is working on an overhauled device that will offer DVR capabilities and support iTunes TV show subscriptions.

As Piper Jaffray analyst Gene Munster wrote back in August: “Apple could leverage its deep library of content with many network and cable channel content owners to provide unlimited access to a sub-library of its TV shows for a standard monthly fee ($30 or $40 per month).”

According to Munster, “Such a product would effectively replace a consumer’s monthly cable bill (~$85/month) and offer access to current and older episodes of select shows on select channels. The selection would dictate the value, and several tiers could be offered, but we see this as one way for Apple to leverage its large iTunes content library as well as its unique Apple TV hardware in order to get digital video to the TV for a price significantly less than the average cable or satellite TV bill.”

Sounds sweet, right? And it would be sweeter still if it were to offer App Store support and allow users to control games and other apps via iPhone or iPod touch …

Below, the official Apple (AAPL) release:

Apple Introduces Apple TV 3.0 Software With Redesigned User Interface

Enjoy iTunes Extras, iTunes LP & Genius Mixes on Your HD TV

CUPERTINO, Calif., Oct. 29 — Apple® today introduced new Apple TV® 3.0 software featuring a redesigned main menu that makes navigating your favorite content simpler and faster, and makes enjoying the largest selection of on-demand HD movie rentals and purchases, HD TV shows, music and podcasts from the iTunes® Store even better on your TV. You can now enjoy iTunes Extras and iTunes LP in stunning fullscreen with your Apple TV, as well as listen to Genius Mixes and Internet radio through your home theater system. The new Apple TV software is available immediately free of charge to existing Apple TV owners, and Apple TV with 160GB capacity is available for just $229.

“The new software for Apple TV features a simpler and faster interface that gives you instant access to your favorite content,” said Eddy Cue, Apple’s vice president of Internet Services. “HD movies and HD TV shows from iTunes have been a huge hit with Apple TV customers, and with Apple TV 3.0 they get great new features including iTunes Extras, Genius Mixes and Internet radio.”

The redesigned main menu on Apple TV gives you instant access to your favorite content. Recently rented or purchased movies, as well as other content including TV shows, music, podcasts, photos and YouTube, are accessible directly from the new main menu. The new software also allows Apple TV users to enjoy stunning fullscreen iTunes Extras and iTunes LP, including great new movie titles such as “Star Trek” or classics like “The Wizard of Oz” and albums such as Taylor Swift’s “Fearless (Platinum Edition)” and Jack Johnson’s “En Concert.” iTunes Extras gives movie fans great additional content such as deleted scenes, interviews and interactive galleries. iTunes LP is the next evolution of the music album, delivering a rich, immersive experience for select albums on the iTunes Store by combining beautiful design with expanded visual features like live performance videos, lyrics, artwork, liner notes, interviews, photos, album credits and more.

Now Apple TV users can enjoy Genius Mixes through their home theater system and listen to up to 12 endless mixes of songs that go great together, automatically generated from their iTunes library. Customers can also enjoy Internet radio, allowing them to browse and listen to thousands of Internet radio stations, as well as tag favorite stations to listen to later. Apple TV’s support of HD photos is enhanced with iPhoto Events, which simplifies finding your favorite photos on Apple TV, as well as iPhoto® Faces, which gives access to photos organized by people identified in iPhoto.

Apple TV users have direct access to a catalog of over 8,000 Hollywood films on iTunes including over 2,000 in stunning HD video available for rent or purchase. Users can also choose from a selection of 11 million songs, 10,000 music videos and over 50,000 TV episodes to purchase directly from their Apple TV or browse and enjoy the iTunes Store podcast directory of over 175,000 free video and audio podcasts. Purchases downloaded to Apple TV are automatically synced back to iTunes on the user’s computer for enjoyment on their Mac® or PC or all current generation iPods or iPhones.* iPod touch® or iPhone® users can download the free Remote app from the App Store to control their Apple TV with a simple tap or flick of the finger.

It’s not the $974.5 million TiVo had been looking for, but the $200 million in sanctions against EchoStar’s DISH Network the company has been awarded isn’t exactly petty cash, either. On Friday, a U.S. District Court judge for the Eastern District of Texas ordered the satellite broadcaster to cough up that sum for its continued infringement of TiVo’s “multimedia time warping system” patent. This in addition to the $192.7 million EchoStar was ordered to pay for violating that same patent up to April 2008.

You see, DISH, though it had been barred from shipping DVRs with the patent-infringing functionality, continued to do so, justifying its behavior by claiming it had implemented a noninfringing workaround. But in June of this year, a court found that not to be the case. The court again reprimanded EchoStar (SATS) and ordered the company to pay TiVo (TIVO) $103 million in additional fines for the violations that occurred during the time in which the “workaround” was implemented. And now, it has added another $200 million to that.

TiVo, as one might imagine, was overjoyed by the ruling, which leaves open the possibility of further sanctions if EchoStar does not abide by the injunction.

“We are pleased by the Court’s ruling to impose contempt sanctions of approximately $200 million against EchoStar for its continued violation of a Court-ordered permanent injunction, and to award TiVo its attorney fees and costs incurred during the contempt proceedings,” the company said in a statement. “This brings total damages and sanctions in this case to approximately $400 million through July 1, 2009, plus attorney fees, and is exclusive of potential further damages and sanctions. Additionally, we are pleased that the Court ‘will seriously entertain the award of enhanced sanctions’ if ‘EchoStar is unsuccessful on appeal and nevertheless continues to disregard this Court’s orders.’”

Who knows, if DISH keeps it up, TiVo may get that $974.5 million yet.

Reporting a second-quarter loss and projected results below Wall Street expectations Wednesday, the digital video recorder pioneer said it is suing the two telecoms for infringing on its patents for technology that allows DVRs to simultaneously store and play back programs, pause live television and deliver other features.

TiVo’s (TIVO) complaint seeks both damages for past infringement and a permanent injunction–similar to the one it won against satellite provider Dish Network (DISH)–that would force AT&T (T) and Verizon (VZ) to shut down their DVR services.

“Attempts were made to reach a commercial arrangement,” TiVo CEO Tom Rogers said during an earnings call today. “They were not reached. We believe we are being caused irreparable harm and that harm increases everyday this doesn’t cease. We have found ourselves in a similar situation with AT&T and Verizon. We need to stop their continued unauthorized use of our intellectual property.”

And, God willing, corral them into that commercial arrangement to which Rogers refers. After all, the company lost 146,000 subscribers in its second quarter. It desperately needs to do something to win new ones and lower its churn.

Though it was eagerly anticipated by the industry and Sirius subscribers, the satellite radio provider never expected that much from its new iPhone App.

During a call with analysts Thursday to discuss second-quarter earnings, Sirius CEO Mel Karmazin said the app, which is currently the iTune App Store’s fourth most popular app in the music category and the 88th most popular overall, was intended more as a means of tempering subscriber churn than a means of driving new subscriptions.

“…unlike an awful lot of applications on the iPhone…we’re not offering free service,” Karmazin said. “What we are offering is the free download and a week’s trial, so this was never designed that we believe we were going to get a significant number of new subscribers. We are seeing an increase in the number of subscribers who are signing up for the $2.99 fee, to be able to stream the product in addition to having it, so a satellite radio subscriber who also has an iPhone is now able to do that with an incremental $2.99.”

So the app is bringing in some new revenue. How much isn’t clear though, since Sirius doesn’t break iPhone app numbers (subscribers or revenue) out. Karmazin admits, however, that it’s not much. “You should not consider them to be a very significant number related to our number of subscribers,” he said, adding, “It’s the right thing for us to do, we continue to believe in it, we’ll continue to do more of these things.”

If you thought the decline in subscribers Sirius XM Radio posted in its first quarter was ugly, you ain’t seen nothing yet. With the souring economy weighing heavily on the auto industry–a mainstay of Sirius’s business–and partner Chrysler navigating bankruptcy, the struggling company is bracing itself for continued subscriber losses in its second quarter.

“Chrysler’s bankruptcy and announced factory shut-down will impact second quarter numbers by reducing the number of prepaid bundled subscriptions associated with the production and shipment of new cars,” Jim Meyer, Sirius’s President of Operations and Sales, said during a conference call last week. “There will be a noticeable hit to subscribers in the second quarter, as a result of these production halts.”

A noticeable hit. What does that mean? Sirius didn’t say at the time, but a filing the company made with the SEC today gives us a clearer picture–and it’s not a pretty one. Chrysler sent quite a bit of new business Sirius’s way. From the Risk Factors item in the company’s 10-Q filing:

We do not expect to generate a significant number of new subscribers from Chrysler while its plants are closed. During the year ended December 31, 2008, Chrysler produced approximately 900,000 vehicles which included a satellite radio and a prepaid subscription to our service. These subscribers represented approximately 16% of our gross subscriber additions in 2008.”

Now, there’s no telling how long the Chrysler factory shutdown will last, so it’s impossible to know how much of an impact it will have on Sirius. That said, if the company’s bankruptcy proceedings drag on for any length of time, it obviously does not bode well for Sirius, especially since XM is potentially facing a similar scenario with General Motors (GM). Again, from the Sirius 10-Q:

There is also significant uncertainty surrounding General Motors’ future and potential filing for bankruptcy protection. A bankruptcy filing by General Motors could have similar effects on our subsidiary, XM.

And that would be grim news indeed. Because while Sirius has stopped counting on its auto partnerships to drive sales, it hasn’t yet established other means of driving subscriptions.

Apparently satellite mogul Charlie Ergen’s run at Sirius XM has been in the works for quite some time. Indeed, “people familiar with the situation” tell The Wall Street Journal that Ergen made an offer late last year to take control of struggling satellite radio outfit, but was rebuffed. His proposal: that one of his two satellite companies, EchoStar (SATS) or Dish Network (DISH), supply Sirius with enough capital to meet its debt obligations and avoid a bankruptcy filing. Clearly, then, Ergen isn’t looking to force Sirius into bankruptcy in order to claim its assets on the cheap, but rather because he sees it as a natural complement to his television operations.

Sirius CEO Mel Karmazin obviously doesn’t share that view, though he may soon come round.

With just a week or so left until its first round of debt obligations come due, Sirius (SIRI) is in a tight spot. As Karmazin told investors last week, the company needs to raise $175 million, and quickly. If it can’t, it will end up either filing for bankruptcy or cutting a deal with Ergen. Given that Karmazin himself invested $2.7 million in Sirius stock last summer, Karmazin may well opt for the latter. Unless, of course, another potential investor–say AT&T (T) or Liberty Media (LINTA)–comes sniffing around. Either way, it’s going to be a volatile and stressful week for Sirius investors.

Sirius CEO Mel Karmazin pulled it off: At the satellite radio outfit’s shareholder meeting today, a proposal to enact a reverse stock split and another to increase the number of authorized shares of Sirius XM (SIRI) common stock from 4,500,000,000 to 8,000,000,000 passed. The reverse split plan could reduce the number of outstanding shares to a range of 65 million to 320 million shares from 3.2 billion.

What’s more, the company reaffirmed its 2009 revenue estimate of $2.7 billion. Quite a victory for Karmazin, who’s been facing a fair bit of shareholder discontent and more than a few calls for his ouster.

Your report card is your stock price.”

– Sirius XM CEO Mel Karmazin, August 2007

In November of 2007, shares in Sirius XM (SIRI) were trading at $3.94. Today they’re at $.13. Suffice to say, the company’s shareholder meeting tomorrow will be a critical one for the struggling satellite radio outfit and for CEO Mel Karmazin, who’s presided over its more than 85 percent decline in–some might say destruction of–shareholder value. And now, with $1 billion in debt coming due in 2009, and Sirius in serious danger of being delisted, Karmazin faces the uniquely difficult task of convincing ornery shareholders to back a reverse stock-split measure. If they do, the company will be able to put off that Nasdaq delisting notice that’s clearly been in the offing for some time now.

But it’s going to be a tough sell. Already, a number of investors are vehemently opposing the idea, among them, the Save Sirius coalition, which is pursuing legal action against the satellite broadcaster and its leadership for alleged violation of fiduciary duties.

Filed in early November, the suit accused the satellite broadcaster and its leadership of severely damaging shareholder value in violation of their fiduciary duties. Among the group’s gripes against Sirius: “locking shareholders into the longest merger delay in history; preventing the corporation from seeking alternatives or potential suitors; failing to commercially introduce interoperable radios; insisting on going forward with the merger at any and all costs; and consummating the merger, issuing 300 million shares to the financiers of XM’s debt to be sold short on the open market.”

Searing claims. Unfortunately for Save Sirius and its founder Michael Hartleib, they’re far too lacking in specificity for a court to take them seriously. “The majority of Mr. Hartleib’s arguments to show the futility of making a demand on the current Sirius board are based on generalized, not specific allegations,” Judge Cormac J. Carney wrote in an order dismissing the suit. “Although the complaint identifies alleged fraud and wrongdoing committed by Defendants, it does not state how each specific Sirius director was responsible for those actions.”

Hartleib, for his part, was unfazed by the dismissal. “The case is not over at all,” he said. “We have twenty days to resubmit, and we shall.”

As of this writing SIRI was trading at $.15, about double its 52-week low.

It’s brought Howard Stern and Oprah Winfrey together under a single aegis.

This morning the DOJ approved the merger of satellite radio companies Sirius Satellite Radio (SIRI) (home to Stern) and XM Satellite Radio (XMSR) (home to Winfrey), a move that will create a satellite radio company with about 14 million subscribers.

In a statement, the DOJ said it found no reason to think that combining the only two satellite radio players in the market would create a pay-radio monopoly. “After a careful and thorough review of the proposed transaction, the division concluded that the evidence does not demonstrate that the proposed merger of XM and Sirius is likely to substantially lessen competition, and that the transaction therefore is not likely to harm consumers,” the DOJ explained.

“The Division reached this conclusion because the evidence did not show that the merger would enable the parties to profitably increase prices to satellite radio customers for several reasons, including: a lack of competition between the parties in important segments even without the merger; the competitive alternative services available to consumers; technological change that is expected to make those alternatives increasingly attractive over time; and efficiencies likely to flow from the transaction that could benefit consumers,” said the DOJ.

“Comcast 3.0.” That was the subject of Comcast CEO Brian Roberts keynote address at the Consumer Electronics Show today. And what is “Comcast 3.0?” Well, like Web 2.0 and 3.0, it’s a marketing term–in Comcast’s case, one for its transformation from “broadband” provider to a “wideband” provider.

In 2008, said Roberts, Comcast will begin upgrading its network to offer significantly faster download speeds. “Wideband takes four channels and bonds them together and will enable speeds to go up from 12 to 16 megabits a second to over 100 megabits a second,” he explained. The technology will be rolled out to “millions” by the end of this year, with more to come–”if it’s as popular as we expect,” he added.

And it undoubtedly will be. At speeds like that, Roberts noted, you could download an HD copy of “Batman Begins” in about four minutes. “Superfast movie downloads are only the beginning,” Roberts said. “This will open a whole new world of Web-based innovation.”

A few other points worth noting:

Roberts also announced “Project Infinity,” an effort to exponentially expand its video-on-demand programming. “Comcast will put 1,000 HD choices in every Comcast HD home by the end of the year,” Roberts said. “What satellite says they’ll offer pales in comparison.”

Comcast is now the country’s fourth largest residential phone provider.

Finally, he pitched Fancast.com, a new online-entertainment portal that gathers film, TV and videos scattered across the Internet in one place. “It’s the content-hungry consumer’s dream,” Roberts said. “With user-generated content, there’s the possibility of millions of choices. You’ll never want to get off the couch.”

With little more than a year to go before television in the states goes all-digital, the federal government is doing its best to make the transition easier for couch potatoes dreading the looming obsolescence of their rabbit-eared sets.

Yesterday, the Commerce Department began accepting applications for $40 coupons to defray the cost of a basic digital-to-analog converter box (expected to sell for between $50 and $70) that will allow older TVs to receive digital broadcast signals. “There is a big change in television coming on Feb. 18, 2009, and people who have old televisions who receive free over-the-air broadcasting, which means they are not hooked up to cable or satellite or another pay-TV service, have to make a decision,” Meredith Atwell Baker, deputy assistant secretary of the National Telecommunications and Information Administration, told Broadcast Newsroom. “They have three choices. They can buy a new TV that’s digital, they can subscribe to cable or satellite or another service, or they can buy a converter box. Otherwise, their television won’t work.”

The coupons are available on a first-come, first-served basis at www.ntia.doc.gov/dtvcoupon/index.html. And there are about 33 million of them available. Great news for the estimated 26 million households in the United States that have yet to make the jump to digital TV.

According to “a reliable industry insider,” the touchscreen iPod that Apple is expected to uncrate tomorrow will support digital radio. “The source said that the new iPods will be able to receive digital radio, and will include a ‘buy-now’ function to allow the user to download and buy tracks as they are being played,” Vnunet reports. “This facility will be limited to tracks sold from the iTunes store, but Apple hopes to dramatically increase the number of tracks available via the service.”

An interesting rumor, and one we’ve heard before. Back in 2004 word on the street had it that Apple had cut a deal with Sirius to offer an iPod with a built-in satellite radio receiver. But it hadn’t. And according to Sirius CEO Mel Karmazin, it probably never would, because the feeling at Apple was that “they don’t need to put a satellite radio in their box.”

Has Apple reconsidered its position in the ensuing years? It’s certainly possible. Remember Jobs once said “people don’t want to watch video on their iPod” too.
