After 17 months of litigation, the hammer has finally fallen on Psystar. The U.S. District Court for the Northern District of California on Tuesday granted Apple’s request for permanent injunction against the Mac clone maker, barring it from peddling PCs with the Mac OS X operating system preinstalled, circumventing the technological measures Apple uses to prevent unauthorized copying of Mac OS X and assisting others in doing so.
If this isn’t the end of the line for Psystar, it’s damn near close to it. According to court papers filed Tuesday, the Mac clone maker has opted to pay Apple $2.7 million in damages rather than continue its ill-starred legal battle with the company. That’s quite a sum for Psystar, whose total assets, according to its bankruptcy filing, are no more than $50,000.
Psystar’s 17-month legal battle with Apple may not end in the Mac clone maker’s total obliteration. The two companies have agreed to a partial settlement, court documents show. Odd that Apple, which just days ago seemed intent on hanging Psystar’s lifeless body from the gates of 1 Infinite Loop, would agree to such a thing.

In an order signed last Friday, U.S. District Court Judge William Alsup ruled that Psystar–whose antitrust complaint against Apple was tentatively dismissed last year–can refocus that complaint around copyright misuse.
In its last legal salvo against Psystar, Apple suggested the Mac clone maker was backed by a silent third party or two. And at this point it better be, because there’s going to be hell to pay when Apple legal is through with it, regardless of how Psystar revises its original complaint.
Psystar’s ideological crusade against Apple is fast turning into a boondoggle for the Mac clone maker. On Tuesday, a federal judge dismissed Psystar’s antitrust lawsuit against Apple and with it, one of the company’s last remaining chances to stay in business peddling PCs with Apple’s Mac OS X Leopard preinstalled, an apparent violation of Apple’s software license agreement.
Mac clone maker Psystar isn’t letting its uncertain future undermine its product road map. Though embroiled in a nasty legal spat with Apple over the legality of its use of Mac OS X in its Open Computer, Psystar this week defiantly began shipping Mac clones with both Blu-ray drives and GeForce 9800GT video cards, neither of which is available in official Macs.
Apple legal has some interesting weekend reading ahead of it. Mac clone maker Psystar filed its 54-page countersuit against Apple late Thursday and, as expected, it accuses the company of restraint of trade, unfair competition, and other violations of antitrust law.
