Score one for Psystar. The unauthorized Mac clone maker has won the right to continue its countersuit against Apple. In an order signed last Friday, U.S. District Court Judge William Alsup ruled that Psystar–whose antitrust complaint against Apple was tentatively dismissed last year–can refocus that complaint around copyright misuse.

Psystar’s ideological crusade against Apple is fast turning into a boondoggle for the Mac clone maker. On Tuesday, a federal judge dismissed Psystar’s antitrust lawsuit against Apple and with it, one of the company’s last remaining chances to stay in business peddling PCs with Apple’s Mac OS X Leopard preinstalled, an apparent violation of Apple’s software license agreement.

Mac clone maker Psystar isn’t letting its uncertain future undermine its product road map. Though embroiled in a nasty legal spat with Apple over the legality of its use of Mac OS X in its Open Computer, Psystar this week defiantly began shipping Mac clones with both Blu-ray drives and GeForce 9800GT video cards, neither of which is available in official Macs.

After twice failing to meet a deadline to formally respond to Apple’s charge that its OpenMacComputer Mac clones violate Apple copyrights, Psystar has finally answered Apple’s July 3 lawsuit–with one of its own. On Tuesday the company filed paperwork for a countersuit that accuses Apple of tying its OS to its hardware in violation of the Sherman Antitrust Act and the Clayton Antitrust Act.
