The plaintiffs in the suit against Microsoft have narrowed its scope a bit and <a href="http://www.techflash.com/microsoft/Plaintiffs_try_to_resurrect_Vista_Capable_class_action_40404262.html">are asking a federal judge to reinstate its class-action status</a>. The suit originally applied to all buyers of so-called &#8220;Windows Vista Capable&#8221; machines. Now, it applies only to those who purchased Windows Vista Capable PCs in Microsoft&#8217;s Express Upgrade Guarantee program.  &#8220;Plaintiffs believe that the analysis as to these narrowed classes, and specifically to the proposed proof of proximate cause, is materially different from the analysis that pertained to the larger class and is consistent with the court&#8217;s prior rulings on class-certification issues,&#8221; <a href="http://media.techflash.com/documents/vistarecertification.pdf">the plaintiffs wrote in a motion requesting certification of a smaller class</a>.</p>
<p>With potentially <a href="http://www.computerworld.com/action/article.do?command=viewArticleBasic&amp;articleId=9128729&amp;intsrc=news_ts_head">millions of dollars in compensatory damages at stake here</a>, there&#8217;s no way Microsoft (MSFT) will allow the motion to go unchallenged.</p>
<p>The trial is currently set to begin April 13, unless the plaintiffs succeed in having it postponed.</p>

The next iteration of Keynote, Apple&#8217;s presentation application, offers some new object transition features: object zoom, a swing transition (Schiller demos it with a Bush-to-Obama slide that gets a laugh from the audience). There are also some new text transitions and chart animations. Finally, Apple&#8217;s offering a Keynote Remote application. It&#8217;s an iPhone app, of course. Cost: 99 cents.</p>
<p>Pages, Apple&#8217;s word processing application, is also getting a bit of an update. Pages &rsquo;09 offers a full-screen view for the easily distracted writer, dynamic outlining, mail merge with Numbers&#8211;Apple&#8217;s spreadsheet program&#8211;and 40 new templates. Not the most exciting stuff, here, but decent additions nonetheless.</p>
<p>In Numbers, Apple (AAPL) has added some new categorization features&#8211;Table Categories, and, answering user requests, some 250 new formulas and functions. New charts, trend lines and other advance reporting options as well.</p>
<p>iWork is also migrating from the desktop to the cloud&#8211;in a sense. Via iWork.com, users can easily upload documents and share them with collaborators. Docs are viewable online. They can be downloaded. And collaborators can comment on them online. iWork.com is cross-platform (Mac and PC) and cross-browser. The online suite looks very much like the Mac-based suite.</p>
<p>iWork will run you $79, $49 if you purchase a new Mac. &#8220;This is the beginning of a new service,&#8221; Schiller noted, adding that it&#8217;s a beta and launches today, solo and as part of a $169 box set that includes iLife and Leopard. </p>

Here we are, just two weeks before the 2008 presidential election and the integrity and accuracy of some of the electronic voting machines that will determine its outcome are <a href="http://arstechnica.com/news.ars/post/20081024-study-sequoia-e-voting-machines-disturbingly-easy-to-hack.html">in question</a>. </p>
<p><a href="http://digitaldaily.allthingsd.com/20080912/got-a-verifiable-paper-trail-for-those-phantom-voters/">Again</a>.</p>
<p>According to <a href="http://www.freedom-to-tinker.com/blog/appel/report-sequioa-avc-advantage">new research from the Princeton University Center for Information Technology Policy</a>, the Sequoia AVC Advantage machines used throughout New Jersey and Louisiana, and in a few counties in Colorado, Virginia, Wisconsin and Pennsylvania as well,  <a href="http://citp.princeton.edu/voting/advantage/">can be hacked in eight minutes</a> to manipulate vote tallies.</p>
<p>From <a href="http://coblitz.codeen.org/citp.princeton.edu/voting/advantage/advantage-insecurities-redacted.pdf">the Princeton report</a>:</p>
<blockquote><p>The AVC Advantage contains a computer. If someone installs a different computer program for that computer to run, it can deliberately add up the votes wrong. It&#8217;s easy to make a computer program that steals votes from one party&#8217;s candidates, and gives them to another, while taking care to make the total number of votes come out right. It&#8217;s easy to make this program take care to cheat only on election day when hundreds of ballots are cast, and not cheat when the machine is being tested for accuracy. This kind of fraudulent computer program can modify every electronic &#8216;audit trail&#8217; in the computer. Without voter-verified paper ballots, it&#8217;s extremely hard to know whether a voting machine (such as the AVC Advantage) is running the right program.&#8221;</p></blockquote>
<p>Damning allegations and ones which Sequoia categorically denied after unsuccessfully <a href="http://www.freedom-to-tinker.com/blog/appel/judge-suppresses-report-voting-machine-security">attempting to suppress them</a>. According to Sequoia, its voting machines are vulnerable only in a classroom setting. In real-life election scenarios, they&#8217;re just fine. &#8220;&#8230;Simple, established, and previously used accuracy and security protections&#8211;removed from the Advantages studied in the report published by the plaintiffs&#8211;make the items in their report next to impossible,”  <a href="http://www.sequoiavote.com/press.php?ID=74">Sequoia said in rebuttal to Princeton researchers&#8217; claims</a>. &#8220;In fact, many of the scenarios painted by plaintiffs depend on the existence of crooked, malicious, and corrupt pollworkers, while the success of some scenarios depends on both corrupt pollworkers and inattentive voters.&#8221;</p>
<p>How reassuring.</p>
<p>Well, at least they&#8217;re not <a href="http://www.pcworld.com/businesscenter/article/152649/voters_allege_evoting_machines_switching_votes.html">switching votes between candidates</a> like some of those touchscreen systems in West Virginia, right? </p>

In China, a nation where <a href="http://global.bsa.org/idcglobalstudy2007/studies/2007_global_piracy_study.pdf">82 percent of all software is unlicensed</a>, many are lambasting the company over its Windows Genuine Advantage program, which blackens the desktop backgrounds of PCs running unlicensed copies of Windows and pesters their owners with constant warning messages.   </p>
<p><a href="http://digitaldaily.allthingsd.com/files/2008/10/blasckscreenofdeath.jpg" rel="lightbox"><img src="http://digitaldaily.allthingsd.com/files/2008/10/blasckscreenofdeath-300x187.jpg" alt="" title="blasckscreenofdeath" width="300" height="187" class="aligncenter size-medium wp-image-7227" /></a></p>
<p>&#8220;[Microsoft is] the biggest hacker in China with its intrusion into users&#8217; computer systems without their agreement or any judicial authority,&#8221; said <a href="http://www.chinadaily.com.cn/china/2008-10/22/content_7126895.htm">attorney Dong Zhengwei, who filed a complaint against the company</a> with the Ministry of Public Security. &#8220;Microsoft&#8217;s measure will cause serious functional damage to users&#8217; computers and, according to China&#8217;s Criminal Law, the company can stand accused of breaching and hacking into computer systems of Chinese. I respect the right of Microsoft to protect its intellectual property, but it is taking on the wrong target with wrong measures.&#8221;</p>
<p>So what are the &#8220;right&#8221; measures, then? Offering Microsoft (MSFT) software for free in China? Sounds like it. <a href="http://www.china.org.cn/china/national/2008-10/21/content_16646396.htm">According to a survey of 574,923 PC users on Chinese portal QQ.com</a>, 73.33 percent of respondents said they were using pirated versions of Windows XP, and 51.58 percent said they intend to continue using pirated versions. Just 15.55 percent said they plan to buy a licensed copy of the software.  </p>

A judge has <a href="http://newteevee.com/2008/10/04/court-temporarily-shuts-down-realdvd/">issued a temporary ban</a> on sales of Real&#8217;s RealDVD software in the wake of a lawsuit brought against it by the Motion Picture Association of America. Point your browser at <a href="http://www.realdvd.com/">the RealDVD site</a> today and you&#8217;ll be greeted with the following message: </p>

<p>Good luck with that, folks.</p>
<p>As I&#8217;ve noted here before, RealDVD is a nice idea&#8211;a $30 software program that easily copies entire DVDs, right down to the menus, bonus features and cover art. And it does so in an ostensibly legal way. What it doesn’t do, though, is prohibit users from ripping DVDs that they rent. Effectively, users are on the honor system, which isn&#8217;t exactly a Hollywood-approved DRM scheme.</p>

<p>Like other DVD rippers, the $30 software program easily copies entire DVDs&#8211;right down to the menus, bonus features and cover art. But unlike those rippers, RealDVD does so in an ostensibly legal way. It copies them without breaking their digital rights management schemes by installing a second layer of DRM on the ripped files that prevents users from sharing the DVDs online. </p>
<p>What it doesn&#8217;t do, though, is prohibit users from ripping DVDs that they rent. Effectively, users are on the honor system. And last I checked, the honor system isn&#8217;t a Hollywood-approved DRM scheme.</p>
