Everyone&#8217;s hustling, that&#8217;s for sure. It&#8217;s this week&#8217;s theme.</p>
<p>BoomTown was there Thursday when Facebook announced a new look for profiles and homepages that incorporates a &#8220;timeline&#8221; or &#8220;stream&#8221; of realtime updates. According to CEO Mark Zuckerberg, “This creates a <a href="http://kara.allthingsd.com/20090305/timeline-stream-for-facebook-imitation-is-the-sincerest-form-of-flattery/">continuous stream of information</a> that delivers a deeper understanding for everyone participating in it.&#8221; It&#8217;s also reminiscent of some other sites, not that it&#8217;ll matter much in the long run. Speaking of Twitter, BoomTown got impatient waiting around for its revenue strategy to materialize and went ahead and started a &#8220;Twitter Business Plan Count-Up.&#8221; The Chia-Twit has potential, but the winning financial strategy so far, by a mile, is the &#8220;Snuggie-Tweet.&#8221; <a href="http://kara.allthingsd.com/20090306/twitter-business-plan-count-up-snuggie-tweet/">BoomTown describes it best.</a></p>
<p>MediaMemo was all (well, almost all) about old media vs. new media. This week. Hulu, which lets you watch Fox and NBC shows on your computer, <a href="http://mediamemo.allthingsd.com/20090306/hulu-brushes-off-boxee-and-boxee-comes-back-for-more/">has been playing tug-of-war</a> with Boxee, which lets you watch Web video on your TV. Hulu and its TV programmer owners don&#8217;t really want you to have that option&#8211;the resulting standoff could be long and interesting. MediaMemo also reported on MegaVideo, the Chinese site that makes it easy to watch pirated TV shows and movies online, noting that <a href="http://mediamemo.allthingsd.com/20090303/hollywoods-napster-moment-arrives-courtesy-of-megavideo/">Hollywood&#8217;s Napster moment</a> has probably just arrived. Universal Music Group&#8211;which has already had its share of Napster moments&#8211;is discussing a <a href="http://mediamemo.allthingsd.com/20090304/will-youtube-music-become-a-reality-heres-hoping/">music site with YouTube</a>. According to MediaMemo, it would be the most likely way to benefit both YouTube and UMG&#8211;not to mention music fans.</p>
<p>Digital Daily must be getting tired of that same old economic refrain. Among the highlights of <a href="http://digitaldaily.allthingsd.com/20090306/crappy-times-are-here-again/">this week&#8217;s crappy news</a>: the jobless rate in Silicon Valley is at 9.3 percent and getting higher. At least Google (GOOG) may be getting some big love soon&#8211;<a href="http://digitaldaily.allthingsd.com/20090305/obamas-cio-pick-brings-new-meaning-to-federal-googlement/">Vivek Kundra</a>, President Obama&#8217;s chief information officer, famously switched 38,000 workers from Microsoft Office to Google&#8217;s Web-based office suite as chief technology officer for the District of Columbia. No word yet on office software for the new White House, but here&#8217;s hoping for a more secure Google Docs. DD also noted the lack of a release date for Palm&#8217;s (PALM) new <a href="http://digitaldaily.allthingsd.com/20090303/sprint-ceo-we-will-sell-no-pre-before-its-time/">Pre</a> from Sprint (S). Apparently it&#8217;ll be a while longer before anyone finds out if the Pre really is an iPhone-killer.</p>
<p>On the Personal Technology front, Walt Mossberg gave Apple&#8217;s (AAPL) <a href="http://ptech.allthingsd.com/20090304/new-safari-browser-succeeds-at-speed-flops-on-features/">new Safari browser</a> a mixed review, and offered his first impressions of <a href="http://mossblog.allthingsd.com/20090303/first-impressions-of-kindle-on-iphone/">Kindle software on the iPhone</a>. In Mossberg&#8217;s Mailbox, Walt answered questions about <a href="http://mailbox.allthingsd.com/20090304/reading-periodicals-on-kindle-2/">reading periodicals</a> on Amazon&#8217;s (AMZN) Kindle 2, keeping a monitor from going to sleep in the middle of a movie, and the benefits of a netbook for traveling. And in the Mossberg Solution, Katie Boehret took an early look at a new <a href="http://solution.allthingsd.com/20090303/buying-and-selling-among-friends/">Oodle-powered Facebook Marketplace</a>, and reported on its pros and cons.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2008/09/myspace_napster.jpg" alt="" title="myspace_napster" width="200" height="200" class="alignright size-full wp-image-5673" />MySpace is no longer just “a place for friends,” deceptively flattering photos and seizure-inducing Web page design, but a place for the music industry as well. This morning <a href="http://online.wsj.com/article/SB122230495872073785.html">the company rolled out MySpace Music</a>, the music destination site with which it hopes to take on Apple&#8217;s (AAPL) iTunes. MySpace Music, in the words of MySpace CEO Chris DeWolfe, is <i>a mega-music experience</i>. &#8220;This is really a mega-music experience that is transformative in a lot of ways,” <a href="http://www.nytimes.com/2008/04/03/technology/03cnd-myspace.html">DeWolfe enthused earlier this year</a>. “It’s the first service that offers a full catalog of music to be streamed for free, with full community features, to be shared with all of your friends.”</p>
<p><a href="http://gigaom.com/2008/09/24/the-fact-fiction-of-myspace-music/">And it certainly is that</a>. With all four of the largest labels on board&#8211;<a href="http://www.alleyinsider.com/2008/9/emi-on-board-myspace-music-launches-tonight">including EMI, which signed on just yesterday</a>, free ad-supported streaming of their catalogs, as well as an Amazon-powered digital music store that sells MP3s playable on the iPod and most other devices&#8211;MySpace will go down in history as the biggest Amazon (AMZN) affiliate <i>ever</i>&#8211;MySpace Music could become a powerhouse in the digital music space. And quickly, too, with 120 million global users, about two-thirds of whom already stream songs to their MySpace pages.  </p>
<p>A big number, 120 million global users. Napster, at its February 2001 peak, had just 26.4 million users worldwide, to whom it promised free music. And look what it did to the industry. </p>
<p><a href="http://digitaldaily.allthingsd.com/files/2008/09/300px-napster_unique_userssvg.png"><img src="http://digitaldaily.allthingsd.com/files/2008/09/300px-napster_unique_userssvg.png" alt="" title="300px-napster_unique_userssvg" width="300" height="240" class="aligncenter size-medium wp-image-5672" /></a></p>
<p>&#8220;When Napster went and set the content free, it was this incredible music experience for users, but it was illegitimate and it didn&#8217;t have a business model backing it,&#8221; <a href="http://blog.wired.com/music/2008/09/myspace-launche.html">MySpace COO Amit Kapur told Wired.com</a>. &#8220;That also wasn&#8217;t designed to win &#8230; how do we create an experience that is designed to win? How do we align the interests of every constituent involved in this process? And that is what we believe we&#8217;ve done.&#8221;</p>
<p>Could be. Clearly, the venture is a noteworthy step for the music industry, whose failure to embrace digital distribution early on has cost it dearly. And it’s one that could pay off. “MySpace has the audience and environment to enable the music industry to get to the next digital level,” <a href="http://www.news.com/8301-10784_3-9910344-7.html">Forrester (FORR) analyst James McQuivey told News.com when the effort was first announced</a>. “What iTunes offers is a good buying experience, but that’s not all people do with music. They talk about it, they share it, they try things out. Remember, this is the kind of activity that (record label) Universal Music Group was suing MySpace for previously. I think the labels said to themselves, &#8216;Oh, if we enable fans to have a fully immersive experience, they might spend more on music.&#8217; MySpace can offer a place where all aspects of the music experience can be expressed. Imeem was getting close to this, but MySpace, if they don’t mess it up, should take Music 2.0.”</p>

			<content:encoded><![CDATA[<p><img src='http://digitaldaily.allthingsd.com/files/2008/05/napster-bad.jpg' alt='napster-bad.jpg' />It took nearly a decade, but Napster&#8217;s finally managed <a href="http://www.news.com/8301-10784_3-9945987-7.html">to license music from all the major labels</a>.</p>
<p>This morning the company, which once terrorized the music industry with free peer-to-peer file sharing, launched what it claims is <a href="http://www.napster.com/index.html?darwin=aladdinV2">the world&#8217;s largest MP3 store</a>. An OS-agnostic shop, <a href="http://investor.napster.com/releasedetail.cfm?ReleaseID=311243">Napster&#8217;s new storefront offers more than 6 million tracks</a> encoded at 256Kbps and priced at 99 cents apiece. The tracks are free of digital rights management protections and playable on virtually any device&#8211;including the iPhone and iPod. </p>
<p>With 6 million songs, Napster (NAPS) has the largest DRM-free catalog of any online retailer. Its selection is about three times the size of Amazon&#8217;s (AMZN), and while Apple&#8217;s (AAPL) iTunes also boasts a catalog of over 6 million songs, only a fraction of those are offered free of copy restrictions.</p>
<p>But really, does that even matter? Because as compelling as Napster&#8217;s new MP3 store might be, it doesn&#8217;t have nearly the reach or mindshare of iTunes&#8211;which, at last check, was <a href="http://www.appleinsider.com/articles/07/06/12/apple_serving_up_1_million_copies_of_itunes_each_day.html">among the most ubiquitous pieces of software around</a>. And how do you compete with ubiquity? Certainly not by failing to support Apple&#8217;s Safari browser, that&#8217;s for sure.<img src='http://digitaldaily.allthingsd.com/files/2008/05/napsafari.jpg' class='centered' style="border: 1px solid #000;" alt='napsafari.jpg' /></p>

			<content:encoded><![CDATA[<p><img src='http://digitaldaily.allthingsd.com/files/2008/03/peter_griffin.jpg' alt='peter_griffin.jpg' />Back in 2000-2001, when the Recording Industry Association of America was still trying to recover from its CD price-fixing scheme with poorly reasoned justifications for CD price inflation (&#8221;Listen, if CD prices were governed by the Consumer Price Index, <a href="http://web.archive.org/web/20031202021246/http://www.riaa.com/news/marketingdata/cost.asp">you&#8217;d be paying $33.86 for them instead of $12.75!&#8221;</a>), a little company called Napster came calling. Napster had pioneered a new Internet distribution model for digital media that was revolutionizing the music industry, and it hoped to partner with RIAA member labels to create a subscription-based service.</p>
<p>At the time, <a href="http://www.comscore.com/press/release.asp?id=249">Napster had some 20 million users worldwide</a> and was essentially the de-facto file-sharing standard. Had the RIAA labels agreed to the alliance, they might have turned peer-to-peer distribution into a new and powerful business model, one with low distribution and marketing costs and a fast developing user base. But they didn&#8217;t. <a href="http://web.archive.org/web/20041211085346/http://www.siliconvalley.com/mld/siliconvalley/business/columnists/gmsv/6728959.htm">They chose another route</a>.</p>
<p>Big mistake. Along came Gnutella. And increased broadband penetration and cheaper storage. Along came Kazaa. And then came BitTorrent. And, well, look at the industry now.</p>
<p>Given such history, it&#8217;s difficult to look at <a href="http://svextra.com/blogs/gmsv/2008/03/dont_think_of_it_as_a_music_tax_think_of_it_more_like_an_insurance_policy.html">the recording industry&#8217;s plan to have a monthly fee added to consumers&#8217; internet-service bills</a> and not shake your head in wonderment.</p>
<p>Portfolio.com reports that Edgar Bronfman Jr.&#8217;s Warner Music Group (TWX) has indeed hired <a href="http://www.theregister.co.uk/2008/03/28/griffin_wmg_p2p_deal/">veteran industry consultant Jim Griffin</a> (no relation to <a href="http://en.wikipedia.org/wiki/Peter_Griffin">Peter</a>, right?) to quarterback a plan under which <a href="http://www.portfolio.com/news-markets/top-5/2008/03/27/Warners-New-Web-Guru">consumers pay an Internet-access surcharge of <a href="http://www.techcrunch.com/2008/03/28/the-music-tax-details-of-the-plan-they-dont-want-you-to-know/">$5 a month</a> for the collective right to freely share music.</a> Those fees would be pooled and divvied up among artists and their labels.</p>
<p>&#8220;Ideally, music will feel free,&#8221; <a href="http://www.portfolio.com/news-markets/top-5/2008/03/27/Warners-New-Web-Guru#page2">says Griffin</a>. &#8220;Even if you pay a flat fee for it, at the moment you use it there are no financial considerations. It&#8217;s already been paid for.&#8221;</p>
<p>Ah- charge <em>everyone</em> for all music. So it is <a href="http://digitaldaily.allthingsd.com/20080313/file-sharing-tax/">Monetization Without Representation</a>. OK. But what gives the music industry the right to tax all broadband users because it suspects some of them might illegally share its content?  And if the music industry deserves that right, then doesn&#8217;t the film industry deserve it as well? And the publishing industry? And <a href="http://www.mathewingram.com/work/2008/03/27/is-a-music-tax-paid-to-isps-the-answer/">any other industry that might benefit </a>from such a tax?</p>
<p>As David Barrett, engineering manager for peer-to-peer networks at Web content-delivery giant Akamai (AKAM), notes Griffin&#8217;s plan is problematic. And desperate.</p>
<p><a href="http://www.portfolio.com/news-markets/top-5/2008/03/27/Warners-New-Web-Guru#page2">Said Barrett:</a>, &#8220;It&#8217;s too late to charge people for what they&#8217;re already getting for free. This is just taxation of a basic, universal service that already exists, for the benefit a distant power that actively harasses the people being taxed without offering them any meaningful representation.&#8221;</p>

			<content:encoded><![CDATA[<p>Yahoo took some time off from <a href="http://digitaldaily.allthingsd.com/20080204/yang-letter/">fretting</a> over its <a href="http://digitaldaily.allthingsd.com/20080201/microhoo/">uncertain future</a> today to ditch its also-ran subscription music service.</p>
<p>This morning the company said it&#8217;s exiting the subscription-music market and  <a href="http://ycorpblog.com/2008/02/04/music-for-the-masses/">throwing its support behind Rhapsody America</a>, a joint venture company owned by RealNetworks and Viacom. In the coming months, Yahoo Music Unlimited subscribers will be transitioned over to Rhapsody and Yahoo will begin promoting the new service on its properties.</p>
<p>The deal leaves us with a subscription services market of three: Rhapsody, Napster and Microsoft&#8217;s Zune Marketplace. And among those, Rhapsody&#8211;with just under 1 million subscribers&#8211;will be the leader. &#8220;This takes away a competitor, and gives Rhapsody potentially some marketing muscle,&#8221; <a href="http://www.usatoday.com/tech/products/services/2008-02-04-yahoo-music-rhapsody_N.htm">Jupiter analyst David Card told USA Today</a>. &#8220;This is good for Rhapsody.&#8221;</p>
<p>Indeed. But only if the deal lasts. And there&#8217;s good reason to believe it won&#8217;t, given Microsoft&#8217;s hostile bid for Yahoo. The software giant and Real <a href="http://www.realnetworks.com/company/press/releases/2003/dec18.html">aren&#8217;t exactly old friends.</a></p>

			<content:encoded><![CDATA[<p><img src='http://digitaldaily.allthingsd.com/files/2007/10/zuckerwaaaaagh.jpg' class='centered' style="border: 1px solid #000;" alt='zuckerwaaaaagh.jpg' />Many, many years ago, when the digital-music business consisted of little else besides Napster and the Recording Industry Association of America&#8217;s lawsuits against it, Apple proved that there was indeed a decent business to be had in selling music online for $1 per song. With iTunes, it quickly established a market for paid downloads as the music industry wrung its hands in utter incomprehension at this new age of digital distribution that was dawning.</p>
<p>So it is ironic, enormously ironic, to hear NBC Universal Chief Executive Jeff Zucker accuse Apple of <a href="http://www.variety.com/article/VR1117974910.html?categoryid=1009&amp;cs=1">ruining the music business</a> (<em>like that second Lindsay Lohan album didn&#8217;t do any damage at all</em>). Speaking at a breakfast organized by Syracuse University&#8217;s Newhouse School, Zucker said Apple &#8220;<a href="http://www.forbes.com/business/2007/10/29/television-nbc-zucker-biz-media-cx_lr_1029zucker.html">destroyed the music business in terms of pricing</a>&#8221; and will invariably do the same to the online video business.</p>
<p>Noting that NBCU booked just $15 million in revenue during the last year of its iTunes deal, Zucker described the company&#8217;s deal with Apple&#8217;s digital media store as one that was corrosive to its media business. “We don’t want to replace the dollars we were making in the analog world with pennies on the digital side,” he said. What Zucker does want is a piece of Apple&#8217;s iPod business. “Apple sold millions of dollars worth of hardware off the back of our content and made a lot of money,” Zucker said. “They did not want to share in what they were making off the hardware or allow us to adjust pricing.”</p>
<p>Can&#8217;t imagine that&#8217;s going to change anytime soon, either&#8211;no matter how loudly Zucker whines. Apple CEO Steve Jobs would probably rather swallow a Zune whole than be pressured into handing over a percentage of iPod sales to record labels, as Microsoft has done with Zune.</p>

<p>This morning, the company said it will soon offer wireless customers <a href="http://ap.google.com/article/ALeqM5jYfyXthme_pUP0FTcVBStpFZDjVQ">the ability to download music over the air from Napster</a>&#8211;at a <a href="http://home.businesswire.com/portal/site/google/index.jsp?ndmViewId=news_view&amp;newsId=20071021005068&amp;newsLang=en">50% to 100% markup over iTunes and Amazon MP3</a>. AT&#038;T is charging $1.99 a track, or $7.49 for five songs from Napster&#8217;s 4 million song library&#8211;prices that, while on par with those offered by Verizon Wireless, are double the 99 cents currently charged by not only Amazon and iTunes, but also Sprint, which reduced the price of its music downloads to 99 cents from $2.49 in March to spur demand. </p>
<p>Rob Hyatt, AT&#038;T&#8217;s director of premium content, acknowledged the steep price point might be off-putting to some, but insisted it wouldn&#8217;t pose a problem for the impulse-control challenged.  &#8220;They&#8217;re very price insensitive,&#8221; <a href="http://www.reuters.com/article/marketsNews/idUKN2137835220071022?rpc=44">he told Reuters</a>.</p>
