Verizon was right. The truth does hurt. And it is especially painful when it’s meted out by a court of law. A U.S. District judge on Wednesday denied AT&T’s request to force Verizon to pull its “There’s A Map For That” and “Island of Misfit Toys” commercials, saying that while the ads might be “sneaky,” they are they are not misleading.
“AT&T did not file this lawsuit because Verizon’s ‘There’s A Map For That’ advertisements are untrue; AT&T sued because Verizon’s ads are true and the truth hurts.” So begins Verizon’s response to AT&T’s complaints about its new ad campaign and as you can see, it pulls no punches. For 53 pages, the new filing mercilessly thrashes AT&T, proving over and over again that the carrier’s carping over Verizon’s ads has transformed a no-win situation into a horrific PR disaster.
Sometimes big news comes in small packages–especially in the world of high tech. This week, AllThingsD covered some little changes that mean serious consequences for the companies that make the stuff and consumers who rely on it.
Beginning Nov. 15, Verizon subscribers looking to get out of their smart-phone contracts early will pay $350 for the privilege. That early-termination fee is double the current one, but Verizon insists it’s justified because of the higher prices of today’s phones. An interesting move for a carrier that just last year agreed to pay $21 million to settle a class-action lawsuit filed by California consumers over the very early-termination fees it is now increasing.
The fight for Skype has ended. After weeks of nasty legal sparring, the Internet telephony service’s founders agreed to join the investor group purchasing it from EBay and dropped the lawsuit that had threatened to bollocks the deal.
If AT&T’s lawsuit over Verizon’s allegedly misleading “there’s a map for that” ad wasn’t a public relations mistake to begin with, it will be by the time Verizon gets through with it. Responding to the suit today, Verizon rep Jeffrey Nelson used it to stoke public perception that AT&T’s network is inferior to Verizon’s.
Analysts mulling over Nokia’s IP infringment suit against Apple seem to be of two minds about how the action will play out. Some see it as a move to cash in on Apple’s iPhone success. Others view it as a preemptory move against a possible infringement suit from Apple aimed at Nokia’s own multitouch handsets.
Though eBay reported a 29 percent drop in profit for its third quarter Wednesday, the company did deliver revenue that was reasonably higher than Wall Street’s expectations. Not that it mattered much. Investors took eBay out to the woodshed anyway, beating its shares down seven percent in after-hours trading.

There is, of course, the upcoming D7 Conference, which promises to be more tech-extravaganza fun than a tweet from @sockington (if only half as cute), but this past week has also seen the launch of our very own iPhone app, meaning that ATD has gone mobile–smart news for your smartphone (we’re still working out potential taglines).
Google’s gone and run afoul of the Department of Justice again. Its interest piqued by the growing outcry over the company’s proposed book-search settlement with authors and publishers, the agency has opened an inquiry.

Earlier this year, Apple COO Tim Cook said the company would use “whatever weapons we have at our disposal” to pursue anyone who “rips off” Apple’s iPhone intellectual property. He’d better hope those weapons are as effective a defense as offense because the company may soon need them. Elan Microelectronics has slapped Apple with a lawsuit claiming the MacBook, iPhone and iPod touch infringe upon touchscreen patents it holds.
Looks the three-hour deposition Microsoft CEO Steve Ballmer gave in the so-called “Vista Capable” class action suit was for naught. A judge Wednesday ruled that the lawsuit, which has troubled Microsoft for nearly two years now, cannot go forward as a class action.
