			<content:encoded><![CDATA[<p>It has been about two years since Apple last released a major firmware update for its Apple TV platform, so <a href="http://www.apple.com/pr/library/2009/10/29appletv.html">the release of Apple TV 3.0 today</a> will come as welcome news to those who own the device. </p>
<p>Apple TV 3.0 is largely as rumored: Adding support for Internet radio, Genius Mixes, iTunes LP and iTunes Extras (bonus clips, interviews, etc.). But it boasts another new feature as well: A redesigned user interface.  </p>

<p>Whether the debut of Apple TV 3.0 heralds a hardware refresh of the device itself is anyone’s guess. It is worth noting, though, that there’s been quite a bit of speculation recently that Cupertino is working on an overhauled device that will offer DVR capabilities and support iTunes TV show subscriptions. </p>
<p><a href="http://digitaldaily.allthingsd.com/20090820/apple-triple-play-itunes-app-tv-and-apple-television/">As Piper Jaffray analyst Gene Munster wrote back in August</a>: &#8220;Apple could leverage its deep library of content with many network and cable channel content owners to provide unlimited access to a sub-library of its TV shows for a standard monthly fee ($30 or $40 per month).&#8221;</p>
<p>According to Munster, &#8220;Such a product would effectively replace a consumer’s monthly cable bill (~$85/month) and offer access to current and older episodes of select shows on select channels. The selection would dictate the value, and several tiers could be offered, but we see this as one way for Apple to leverage its large iTunes content library as well as its unique Apple TV hardware in order to get digital video to the TV for a price significantly less than the average cable or satellite TV bill.&#8221;</p>
<p>Sounds sweet, right? And it would be sweeter still <a href="http://digitaldaily.allthingsd.com/20090604/app-tv/">if it were to offer App Store support</a> and allow users to control games and other apps via iPhone or iPod touch &#8230;</p>

Reporting <a href="http://finance.yahoo.com/news/Netflix-Announces-Q3-2009-prnews-2400223336.html?x=0&amp;.v=1">third-quarter earnings</a> after market close Thursday, the DVD-by-mail pioneer posted net income of $30.1 million, up 48 percent from a year earlier, on revenue of $423.1 million. That’s 52 cents a share.  Analysts had been expecting 46 cents a share on $419.9 million in sales. </p>
<p>And get this: Netflix (NFLX) added a net 510,000 subscribers during the period, 95 percent more than in the same three months last year. In fact, in the past year, Netflix has added 2.4 million subscribers, the most it has signed on in its 10-year history. </p>
<p>&#8220;Our business momentum is strong and our third-quarter performance keeps us solidly on course for a record 2009,&#8221; Netflix CEO Reed Hastings said in a statement.</p>
<p>Given that and the fact that Netflix beat estimates, it’s odd to see investors dragging the company’s shares down. Netflix fell 4.39 percent to 47.45 in after-hours trading.</p>

<p>In a research note issued this morning, Piper Jaffray analyst Gene Munster says the time is right for Apple to release the next iteration of Apple TV&#8211;one that offers DVR capabilities and supports iTunes TV show subscriptions. </p>

<p>Further, Munster notes, &#8220;The selection would dictate the value, and several tiers could be offered, but we see this as one way for Apple to leverage its large iTunes content library as well as its unique Apple TV hardware in order to get digital video to the TV for a price significantly less than the average cable or satellite TV bill.&#8221;</p>
<p>Makes great sense. And if Apple (AAPL) were to launch these services in concert with App Store support, <a href="http://digitaldaily.allthingsd.com/20090604/app-tv/">as Munster has suggested in the past</a>, it would be a pretty compelling proposition. And it would set the stage for the next evolution of the platform, the Apple Television, an Internet-connected TV with onboard DVR and media center functionality. </p>
<p>Says Munster:</p>
<p>&#8220;Beyond new hardware with DVR or iTunes video subscription features, we believe the 2-5 year roadmap for the Apple TV product lineup is robust. To begin with, Internet-connected TVs with interactive features will likely gain popularity in the next several years. Apple could differentiate itself in this market as a seasoned software developer competing largely with television hardware manufacturers that do not excel in the software arena. The device could also bring iPhone games, a relatively new segment for Apple, to the television.</p>
<p>&#8220;While this is unlikely in the near term,&#8221; Munster continues, &#8220;we believe the iPhone will succeed as a portable gaming platform and Apple may consider bringing higher quality games developed on a similar platform to the TV. The iPhone app developer community is already robust, and Apple could leverage those developers to enter the gaming arena on the TV. In fact, the iPhone or iPod touch could itself operate as a touchscreen gaming control for a game-centric Apple TV.&#8221;</p>
<p>Again, this makes great sense, though TV hardware is not an easy business&#8211;just ask Sony (SNE). But, as Munster aptly notes, it might be quite a bit less difficult if Apple were to &#8220;change the rules of the game,&#8221; something it’s done in a number of markets already.</p>
<p>That said, as Media Memo’s Peter Kafka just reminded me, the cable companies are working very closely with Hollywood to make sure it’s difficult for people to replace their cable service. They’d almost certainly attempt to sack an initiative like one Munster describes above.</p>

Or maybe she forgot about the major hurricane barreling toward the Gulf Coast on the eve of the Republican National Convention? Or maybe she didn’t really want to be around a group of conservative Americans in the first place?&#8230;Can Ms. Zuckerberg tell us what the Democratic National Convention did with Facebook&#8211;aside from pet their enlarged egos and take them to glitzy parties with the Hollywood elite&#8211;that Republican National Convention planners didn’t? I guess next time we won’t make the mistake of letting the business of nominating our Presidential candidate get in the way of the folks at Facebook being treated like rock stars. <p>BoomTown was there Thursday when Facebook announced a new look for profiles and homepages that incorporates a &#8220;timeline&#8221; or &#8220;stream&#8221; of realtime updates. According to CEO Mark Zuckerberg, “This creates a <a href="http://kara.allthingsd.com/20090305/timeline-stream-for-facebook-imitation-is-the-sincerest-form-of-flattery/">continuous stream of information</a> that delivers a deeper understanding for everyone participating in it.&#8221; It&#8217;s also reminiscent of some other sites, not that it&#8217;ll matter much in the long run. Speaking of Twitter, BoomTown got impatient waiting around for its revenue strategy to materialize and went ahead and started a &#8220;Twitter Business Plan Count-Up.&#8221; The Chia-Twit has potential, but the winning financial strategy so far, by a mile, is the &#8220;Snuggie-Tweet.&#8221; <a href="http://kara.allthingsd.com/20090306/twitter-business-plan-count-up-snuggie-tweet/">BoomTown describes it best.</a></p>
<p>MediaMemo was all (well, almost all) about old media vs. new media. This week. Hulu, which lets you watch Fox and NBC shows on your computer, <a href="http://mediamemo.allthingsd.com/20090306/hulu-brushes-off-boxee-and-boxee-comes-back-for-more/">has been playing tug-of-war</a> with Boxee, which lets you watch Web video on your TV. Hulu and its TV programmer owners don&#8217;t really want you to have that option&#8211;the resulting standoff could be long and interesting. MediaMemo also reported on MegaVideo, the Chinese site that makes it easy to watch pirated TV shows and movies online, noting that <a href="http://mediamemo.allthingsd.com/20090303/hollywoods-napster-moment-arrives-courtesy-of-megavideo/">Hollywood&#8217;s Napster moment</a> has probably just arrived. Universal Music Group&#8211;which has already had its share of Napster moments&#8211;is discussing a <a href="http://mediamemo.allthingsd.com/20090304/will-youtube-music-become-a-reality-heres-hoping/">music site with YouTube</a>. According to MediaMemo, it would be the most likely way to benefit both YouTube and UMG&#8211;not to mention music fans.</p>
<p>Digital Daily must be getting tired of that same old economic refrain. Among the highlights of <a href="http://digitaldaily.allthingsd.com/20090306/crappy-times-are-here-again/">this week&#8217;s crappy news</a>: the jobless rate in Silicon Valley is at 9.3 percent and getting higher. At least Google (GOOG) may be getting some big love soon&#8211;<a href="http://digitaldaily.allthingsd.com/20090305/obamas-cio-pick-brings-new-meaning-to-federal-googlement/">Vivek Kundra</a>, President Obama&#8217;s chief information officer, famously switched 38,000 workers from Microsoft Office to Google&#8217;s Web-based office suite as chief technology officer for the District of Columbia. No word yet on office software for the new White House, but here&#8217;s hoping for a more secure Google Docs. DD also noted the lack of a release date for Palm&#8217;s (PALM) new <a href="http://digitaldaily.allthingsd.com/20090303/sprint-ceo-we-will-sell-no-pre-before-its-time/">Pre</a> from Sprint (S). Apparently it&#8217;ll be a while longer before anyone finds out if the Pre really is an iPhone-killer.</p>
<p>On the Personal Technology front, Walt Mossberg gave Apple&#8217;s (AAPL) <a href="http://ptech.allthingsd.com/20090304/new-safari-browser-succeeds-at-speed-flops-on-features/">new Safari browser</a> a mixed review, and offered his first impressions of <a href="http://mossblog.allthingsd.com/20090303/first-impressions-of-kindle-on-iphone/">Kindle software on the iPhone</a>. In Mossberg&#8217;s Mailbox, Walt answered questions about <a href="http://mailbox.allthingsd.com/20090304/reading-periodicals-on-kindle-2/">reading periodicals</a> on Amazon&#8217;s (AMZN) Kindle 2, keeping a monitor from going to sleep in the middle of a movie, and the benefits of a netbook for traveling. And in the Mossberg Solution, Katie Boehret took an early look at a new <a href="http://solution.allthingsd.com/20090303/buying-and-selling-among-friends/">Oodle-powered Facebook Marketplace</a>, and reported on its pros and cons.</p>

A judge has <a href="http://newteevee.com/2008/10/04/court-temporarily-shuts-down-realdvd/">issued a temporary ban</a> on sales of Real&#8217;s RealDVD software in the wake of a lawsuit brought against it by the Motion Picture Association of America. Point your browser at <a href="http://www.realdvd.com/">the RealDVD site</a> today and you&#8217;ll be greeted with the following message: </p>

Due to recent legal action taken by the Hollywood movie studios against us, RealDVD is temporarily unavailable. Rest assured, we will continue to work diligently to provide you with software that allows you to make a legal copy of your DVDs for your own use.&#8221;

<p>Good luck with that, folks.</p>
<p>As I&#8217;ve noted here before, RealDVD is a nice idea&#8211;a $30 software program that easily copies entire DVDs, right down to the menus, bonus features and cover art. And it does so in an ostensibly legal way. What it doesn’t do, though, is prohibit users from ripping DVDs that they rent. Effectively, users are on the honor system, which isn&#8217;t exactly a Hollywood-approved DRM scheme.</p>

RealNetworks (RNWK) debuted RealDVD this morning and along with it, a preemptive lawsuit against the Hollywood interests that will inevitably attempt to litigate it into oblivion. Brought against the DVD Copy Control Association and a who&#8217;s-who of major studios, the suit asks the court to rule that <a href="http://www.realdvd.com/">RealDVD</a> complies with the DVD Copy Control Association’s license agreement not only by retaining the &#8220;content scramble system&#8221; used to protect DVDs, but by enhancing it with an additional layer of digital rights management protection. </p>
<p>&#8220;RealNetworks took this legal action to protect consumers&#8217; ability to exercise their fair-use rights for their purchased DVDs,&#8221; <a href="http://www.realnetworks.com/company/press/releases/2008/realdvd_litigation.html">the company said in a statement</a>. &#8220;We are disappointed that the movie industry is following in the footsteps of the music industry and trying to shut down advances in technology rather than embracing changes that provide consumers with more value and flexibility for their purchases. For nearly 15 years RealNetworks has created innovative products that are fully legal, great for consumers, and respectful of the legitimate interests of content creators and rights holders. RealDVD follows in that tradition. We expect to successfully defend our right to make RealDVD available to consumers and consumers&#8217; rights to use it.&#8221;</p>
<p>We&#8217;ll see, I guess. Clearly the silly little “RealDVD is for saving a DVD you own&#8221; disclaimer attached to the software isn&#8217;t going to cut it with Hollywood. I imagine we&#8217;ll be hearing from the Motion Picture Association of America before the day is out.</p>

<p>Richard Winn, director of entertainment development for Zune, says, &#8220;What we would be looking to do with any form of original content is the added component that Zune could provide that iTunes or any competing service couldn&#8217;t.&#8221; </p>
<p>Great, but will that make a difference, with the Zune market share hovering at 4 percent (compared to Apple at 71 percent)? Probably not. This is the same programming/marketing team, after all, that came up with the idea of launching <a href="http://arstechnica.com/journals/microsoft.ars/2008/04/20/zune-joy-division-limited-edition-coming-june-10">a Joy Division version of the Zune</a>. Really&#8211;Zune users are already lonely; no need to make them sad.</p>
<p>Well, it&#8217;s also the team that does the impossible&#8211;defying all rumors of extinction and plugging away on a platform no one uses. Maybe while the Zune team is making the rounds, they&#8217;ll find out who represents U2. </p>

<p>&#8220;Because they’re the super-small-market share guy, they get all these statements about them.” Microsoft (MSFT) Chairman <a href="http://www.macobserver.com/article/2005/05/03.2.shtml">Bill Gates said that about Apple back in 2005</a>. And while it&#8217;s essentially still true, it&#8217;s less so than it has been in years past. In separate reports today, research houses Gartner (IT) and IDC (IDC) both note that <a href="http://www.pcmag.com/article2/0,2817,2325860,00.asp">Apple has climbed to third place</a> in the desktop market in the U.S.<a href="http://www.gartner.com/it/page.jsp?id=724111"> Gartner figures Apple&#8217;s share of  state-side PC shipments for the second quarter of 2008 to be 8.5 percent</a>, up from 6.4 percent in the quarter a year earlier. <a href="http://www.idc.com/getdoc.jsp?containerId=prUS21349408"> IDC pegs it at 7.8 percent for the second quarter this year</a>, up from 6.2 percent in last year&#8217;s second quarter. And that puts the company in third place in the domestic PC market&#8211;ahead of Acer, if you believe Gartner. And in fourth place behind Acer if you believe IDC. </p>
<p>Not that it matters all that much. Because regardless of whose metrics you prefer, Apple (AAPL) still lags far behind the two PC sales leaders. Dell (DELL) is still the No. 1 seller of PCs in the U.S., with 32 percent of the market according to IDC. HP is No. 2, with 25 percent. And in terms of worldwide sales, Apple hasn&#8217;t even cracked the Top 5. Yet.</p>
<p>It&#8217;s definitely No. 1 in Hollywood though, as critic Roger Ebert noted a few years back. &#8220;Macs turn up in the movies all the time&#8211;not so much because of product placement, but because so many movie people use them and like them,&#8221; <a href="http://www.macworld.com/article/29180/2004/02/themacturns20.html">Ebert wrote</a>. &#8220;A historian of the future, counting all the on-screen computers between 1983 and today, would likely conclude that Macs represented 90 percent of the computer market.&#8221;</p>

<p>Lest there be any doubt that DVR functionality was purposefully left out of Apple TV, consider this patent recently unearthed by AppleInsider. Filed in October of 2006, the patent describes not just a version of Apple TV <a href="http://www.appleinsider.com/articles/08/03/13/apple_tv_dvr_interface_revealed_in_patent_filings.html">capable of browsing and recording live TV programming</a>, but a touch-based remote that could be preloaded with upcoming TV listings to facilitate it. From the patent:</p>

For example, program data for upcoming programs, e.g., for the next month, can be downloaded and stored on the remote control device. Thereafter, a user of the remote control device can search programs that are to be broadcast and determine which programs to record. The recording settings can be programmed onto the remote control device, and then be provided to the video device when a data communication is established between the remote control device and the video device.&#8221;

<p>Pretty slick, eh? Lots of additional possibilities here as well. One could easily imagine the iPod Touch and iPhone serving as the remote the patent describes. And if this next-generation Apple TV is capable of recording TV programming, why not make it the gateway through which such programming is delivered? How nice would it be to subscribe to HBO&#8211;and HBO alone&#8211;via iTunes? How nice would it be to subscribe to a season of &#8220;Weeds&#8221;? Or to a commercial-free season of &#8220;The Office&#8221; and skip everything else NBC has to offer? How nice would it be if the latest unwatched episode of &#8220;Weeds&#8221; on your Apple TV was automatically synced to your iPhone for later viewing? How nice would it be if new films opened on iTunes the same day they opened in theaters?</p>
<p>Pipe dream? Perhaps. Certainly, these scenarios would require Apple (AAPL) to ink some fantastical new licensing deals with Hollywood. And the two aren&#8217;t exactly seeing eye-to-eye all the time these days. Still, you never know. <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3i174d24f4a4bd6a9273308815a9663bfc">Stranger things have happened</a>. </p>

<p>Promises, promises, promises &#8230; When Apple (AAPL) debuted iTunes Movie Rentals this past January, the company pledged to offer &#8220;<a href="http://www.apple.com/pr/library/2008/01/15itunes.html">over 1,000 titles by the end of February, including over 100 titles in stunning high-definition video with 5.1 Dolby Digital surround sound.</a>&#8221; Well, today&#8217;s March 4 and, as best I can tell, <a href="http://www.macworld.com/article/132309/2008/02/1000rentals.html">Apple hasn&#8217;t kept its promise</a>. Browse iTunes this morning with the software&#8217;s &#8220;Power Search,&#8221; and you&#8217;ll find just 411 films for rent&#8211;91 of them available in high definition. That&#8217;s 589 short of the promised 1,000&#8211;a discrepancy of nearly 60%.</p>
<p>Seems Apple may not have Apple TV quite right yet after all&#8211;the Hollywood licensing part of it, anyway.</p>
<p><img src="http://allthingsd.com/theme/images/d-mini.png"><strong>UPDATE:</strong> At the Apple shareholder meeting yesterday, <a href="http://www.appleinsider.com/articles/08/03/04/investors_grill_apples_jobs_over_successor_games_future_products.html" rel="nofollow">CEO Steve Jobs confirmed the discrepancy, saying the company&#8217;s goal of 1,000 rental titles on iTunes was short by around 600.</a></p>

<p>Paramount Pictures plans to <a href="http://online.wsj.com/article/SB119750265810925103.html">debut &#8220;Jackass 2.5,&#8221; the third installment of the &#8220;Jackass&#8221; movies, online</a>, <a href="http://technology.timesonline.co.uk/tol/news/tech_and_web/article3045904.ece">skipping the multiplexes entirely</a>. &#8220;2.5&rdquo; will launch Dec. 19 on Blockbuster&#8217;s new online property, Movielink, where it will be streamed free for two weeks. Then, beginning Dec. 26, it will be released on DVD, through video-on-demand and in Apple&#8217;s iTunes Store. An interesting experiment, and one that could pave the way for first-run broadband movies.</p>
<p>But will it succeed? Paramount certainly seems to think so. After all, the film is sort of a long-form version of the rough-edged, occasionally tasteless DIY content that predominates online. Said Tom Lesinski, president of Paramount Pictures Digital Entertainment, &#8220;When you think about what people generally consume online it&#8217;s fairly low-end user-generated content, yet there are hundreds of millions of people online watching video every day.&#8221;</p>
<p>Or as another executive candidly told the New York Times: <a href="http://www.nytimes.com/2007/12/13/business/media/13movie.html">&#8220;There’s more vomiting, nudity and defecation. The stuff that consumers really want.&#8221;</a></p>
