			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/misift1.jpg" alt="misift" title="misift" width="200" height="200" class="alignright size-full wp-image-28841" />As clever as it is, <a href="http://digitaldaily.allthingsd.com/20091109/verizon-banishes-iphone-to-island-of-misfit-toys/">Verizon’s reimagining of a Rankin/Bass animated Christmas television special as a criticism of AT&#038;T&#8217;s wireless network coverage</a> did not go over well with Ma Bell. On Wednesday, the carrier amended its complaint against Verizon, asking a federal court in Atlanta to force its rival to immediately pull the ad and two other holiday-themed spots that debuted with it. </p>
<p>Once again, AT&#038;T (T) argues that  coverage maps featured in Verizon’s (VZ) ad are misleading and falsely suggest that AT&#038;T offers no coverage in areas where it actually does service.  </p>
<p>&#8220;Contrary to the image presented in the Verizon ads, our wireless network is pervasive,&#8221; said an AT&#038;T spokesman. &#8220;It covers over 300 million people, or 97 percent of the U.S. population.  Our fastest, or 3G, network covers approximately 233 million people, or 75 percent of the U.S. population&#8230;.[Verizon's] use of white space is misleading.&#8221;</p>
<p>While AT&#038;T is <a href="http://www.att.com/gen/press-room?pid=14002">deadly serious about this accusation</a>, the fact that it must make it by referencing creatures like the Abominable Snow Monster and a pink spotted elephant makes it, well, hysterical. </p>
<p>&#8220;The &#8216;Island of Misfit Toys&#8217; television advertisement is a parody of the &#8216;Rudolph the Red Nose Reindeer&#8217; television special that depicts an island to which Rudolph travels after escaping an attack from the Abominable Snow Monster,&#8221; AT&#038;T argues in its complaint. &#8220;The advertisement begins with outdated, discarded toys expressing surprise at the arrival of an Apple iPhone. The red Charlie-in-the-Box says &#8216;Hey! Check out the new guy!&#8217; The spotted elephant, in a surprised manner, asks the iPhone &#8216;What are you doing here? You can download apps and browse the web!&#8217; and a Dolly for Sue asserts that &#8216;Yeah. People will love you [the iPhone].&#8217;&#8221; </p>
<p>The complaint continues: &#8220;In response, a blue AT&#038;T coverage map depicting large swaths of &#8216;white&#8217; or &#8216;blank&#8217; space across the United States appears above the iPhone. All the toys exclaim &#8216;Oh . . .&#8217; in dismay, while the iPhone wilts and its screen turns dark. The toy airplane then assures the iPhone that &#8216;you’re going to fit right in here!&#8217;&#8221; </p>
<p>Finally, as AT&#038;T describes it, &#8220;AT&#038;T’s and Verizon’s coverage maps then appear and the announcer states, &#8216;with five times more 3G coverage than AT&#038;T, Verizon Wireless is your destination for great gifts.&#8217; The image of the sad and wilting iPhone on an island of misfit toys falsely communicates that the iPhone is a broken device because it cannot browse the web or download applications when outside of AT&#038;T’s depicted coverage area. Further, the maps in the advertisement deceive consumers into believing that AT&#038;T’s customers have no coverage whatsoever when they are outside of AT&#038;T’s depicted coverage area and thus cannot use their wireless devices in many parts of the United States.&#8221;</p>
<p>Verizon&#8217;s attorneys are probably doubled over with laughter at this very moment.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/GrinchWPre.jpg" alt="GrinchWPre" title="GrinchWPre" width="250" height="250" class="alignright size-full wp-image-28189" />With a handful of new Android handsets arriving at market in the coming weeks, including <a href="http://digitaldaily.allthingsd.com/20091028/droid-follo/">Motorola’s (MOT) much anticipated Droid</a>, Palm’s (PALM) prospects for blowout winter holiday sales are dimming. </p>
<p>Earlier this week, <a href="http://digitaldaily.allthingsd.com/20091102/palm-3/">analysts at Citigroup (C) and CL King voiced their concerns</a> about the company in the wake of <a href="http://digitaldaily.allthingsd.com/20091030/pre-sprint/">another ugly quarter from carrier partner Sprint</a> (S). Now Standard &#038; Poor&#8217;s is doing so as well. In a note to investors today, analyst James Moorman whacked down his price target on the company&#8217;s shares to $10 from $12 and reiterated his &#8220;Strong Sell rating.</p>
<p>&#8220;We believe the upcoming holiday selling season will be very competitive for handset vendors and think Palm could see competitive pressures,&#8221; he wrote. &#8220;We believe the small price difference between the Pre handset (especially when on sale at third party vendors) and the new lower-end Pixie could limit Pixie sales and confuse consumers during the launch.&#8221;<br />

Indeed. As <a href="http://digitaldaily.allthingsd.com/20091026/palm-pixi-launches-nov-15-for-99-after-rebates/">I noted here  last week</a> the $99 price Sprint has set for the Pixi is identical to the Pre’s on Amazon (AMZN). And the Pre has a faster processor, a better screen, and Wi-Fi support as well.</p>
<p>Not the most desirable circumstances for heading into the holiday season.</p>

<p>&#8220;It appears that Amazon is gaining share the old-fashioned way,&#8221; ThinkEquity analyst Ed Weller noted last week, &#8220;by acquiring more and more customers&#8230;and selling more to each of them.&#8221; And judging from <a href="http://finance.yahoo.com/news/Amazoncom-Announces-Third-bw-2993724608.html?x=0&#038;.v=1">the nice gain in third-quarter earnings</a> the company posted after Thursday&#8217;s closing bell, that would seem to be the case. </p>
<p>Net income for the period surged 69 percent thanks to a strong increase in sales. Analysts had been looking for earnings of 33 cents a share on revenue of $5.02 billion for the quarter. Amazon (AMZN) reported 45 cents a share, compared with 27 cents a share for the same period the previous year. Revenue rose 28 percent to $5.45 billion.</p>
<p>Once again, it seems Amazon has not broken out Kindle sales numbers in its report, though CEO Jeff Bezos did stress them in an earnings release. Said Bezos: &#8220;Kindle has become the #1 bestselling item by both unit sales and dollars&#8211;not just in our electronics store but across all product categories on Amazon.com. It’s also the most wished for and the most gifted. We are grateful for and energized by this customer response.&#8221;</p>
<p>Looking ahead to the key fourth quarter, Amazon is calling for revenue in the range of $8.125 billion to $9.125 billion. Analysts have been forecasting revenue of $8.13 billion. Given that the upcoming quarter includes the annual holiday shopping binge, Amazon may be looking at another blowout quarter.</p>
<p>Shares in the company are spiking on the news, up over nine percent to $101.90 as I write this.</p>

<p>In a research note today, FTN Equity Capital Markets analyst James Hardiman said <a href="http://blogs.barrons.com/techtraderdaily/2009/08/17/will-sony-cut-playstation-3-price-tomorrow/">“evidence is mounting” that Sony will announce a PS3 price cut</a>, perhaps during its Tuesday presentation at GamesCon. </p>
<p>Videogame analyst Heath Terry of FBR Capital Markets shares this view, and in a note to clients, he put a dollar figure on the cut. &#8220;With Sony set to announce a $100 price cut on the PS3 on Tuesday at Gamescom in Germany according to our retail checks, we believe the other hardware manufacturers will respond with a combination of price reductions and bundling strategies that should drive significant acceleration in hardware sales,&#8221; Terry wrote, adding that the cut, should it come to pass, will mark &#8220;the first of a series of catalysts that should drive a return to growth&#8221; for the videogame industry.</p>
<p>Certainly, it would give Sony (SNE) a nice boost in sales in the run-up to the winter holiday consumer binge. And <a href="http://digitaldaily.allthingsd.com/20090730/sony-marks-30th-anniversary-of-walkman-with-lousy-earnings/">given its most recent financials</a>, the company could really use one right now.</p>

The company said this week that <a href="http://www.reuters.com/article/rbssTechMediaTelecomNews/idUSN1753249820081118">it is doubling its normal weeklong holiday hiatus</a>. Said an HP spokesperson, &#8220;Shutting down during a period when many employees traditionally take vacation helps HP achieve operational savings and allows employees to enjoy more time with their families.&#8221;</p>
<p>And more time with their jobs as well. With analysts predicting a decline in PC shipments in 2009, there seems now to be little hope that tech spending will withstand the economic downturn. Better to ask that employees take a few more additional holiday vacation days than usual than to surprise them with a permanent vacation later on. Not that this is an inevitability for HP (HPQ). After all, the computer giant seems to be doing a decent job of riding out the econalypse. Today it said it expects to <a href="http://biz.yahoo.com/bw/081118/20081118005637.html">exceed Wall Street&#8217;s earnings expectations</a> for its latest quarter and for the coming year.</p>
