			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/dellephone.jpg" alt="dellephone" title="dellephone" width="200" height="200" class="alignright size-full wp-image-28941" />After nearly three years of rumor and speculation, <a href="http://content.dell.com/us/en/corp/d/press-releases/2009-11-13-dell-confirms-smart-phone-plans.aspx?c=us&amp;l=en&amp;s=gen">Dell is finally entering the smartphone market</a>&#8211;in China and Brazil. Later this month, China Mobile and Brazil’s Claro will begin selling the company’s Mini 3, a handset designed around Google&#8217;s (GOOG) Android mobile operating system. </p>
<p>Why China and Brazil? Well, for one thing, they are developing markets. For another, Dell (DELL) already has partners there. </p>
<p>&#8220;Besides size (China Mobile has over 500 million subscribers, and Claro serves more than 42 million), we have existing telecom partnerships with them,&#8221; Dell blogger Lionel Menchaca said in a post. &#8220;Back in April, we were the first to embed China Mobile’s technology into our Mini 10 netbook. And if you’ve been watching, you know Dell has agreements with lots of other providers like Vodafone in Europe, Australia and New Zealand. We’ve partnered with AT&#038;T and Verizon in the United States to offer mobile broadband on different products, and we have agreements with other carriers in Asia.&#8221;</p>
<p>Interesting. Presumably this means we’ll see the Mini rolled out in short order in these other countries as well. As you may recall, <a href="http://digitaldaily.allthingsd.com/20091007/dellephone-headed-to-att/">Dell was rumored to be building an Android handset for AT&#038;T (T) in early October</a>.</p>

Odd then to learn that it is not the most profitable. And odder still to learn that that honor belongs to Apple, which has been in the handset market for just two years. </p>
<p><a href="http://strategyanalytics.com/default.aspx?mod=ReportAbstractViewer&amp;a0=5118">According to Strategy Analytics</a>, Apple’s third-quarter iPhone operating profit was $1.6 billion, while Nokia’s was $1.1 billion. Driving Apple’s profits: Strong sales, high wholesale prices and tight cost controls.</p>
<p>&#8220;We have identified at least 4 key factors underlying Apple’s success,&#8221; Strategy Analytics analyst Alexander Spektor explains. &#8220;First, Apple created a simple sub-brand&#8211;the iPhone&#8211;which was memorable and easy to remember. Second, the firm developed an attractive family of models with standout usability that enabled Apple to charge way-above-average prices to operators and consumers. Third, Apple distributed and co-marketed its handsets through top-tier carriers in numerous high-value countries. And fourth, the vendor has kept a solid grip on production costs by working with Foxconn, the world’s largest contract handset manufacturer.”</p>
<p>Quite an achievement for Apple (AAPL) and a major humiliation for Nokia (NOK), which has seen its dominance eroded by the likes of Apple and Research in Motion (RIMM), and not just in North America, but in Europe. Indeed, in its latest quarter <a href="http://digitaldaily.allthingsd.com/20091015/nokia-earns/">Nokia’s smart-phone market share dropped by six points</a>. </p>
<p>As Strategy Analytics analyst Neil Mawston noted at the time, &#8220;[Nokia has] no iPhone killer to drive a major revival in its smartphone volumes. [It] is still struggling in the U.S. smartphone market, and with competition intensifying in China as well, Nokia’s battles can only get tougher in 2010.&#8221;</p>

<p>According to Oracle (ORCL) CEO Larry Ellison, Sun (JAVA) is already losing $100 million a month as it waits for regulatory approval, and judging from the price of the company’s stock today, it may be losing even more than that. Shares in Sun slid to $8.11&#8211;about 15 percent below Oracle’s offer price and a far cry from the $9.18 they hit in mid-October. </p>
<p>Clearly, investors are alarmed by this latest turn of events, though industry observers say there’s little reason for them to be. Morgan Stanley, for example, believes Oracle’s acquisition of Sun will win EU approval with few, if any, modifications to the MySQL database software about which regulators are so concerned.  </p>
<p>&#8220;Based on our diligence, we believe the EC is likely to approve the deal with no remedies or remedies pertaining to MySQL’s licensing,” the research house said in a note to clients today. “It is highly unlikely that Oracle restructures the deal (e.g. spins MySQL) or walks away.&#8221;</p>
<p>Morgan Stanley’s call: The deal will go through and at $9.50 per share. As the firm notes, the EU hasn’t blocked a U.S.-based transaction since GE/Honeywell in 2001.</p>

Shares in the company spiked more than $12, or more than six percent, to $202 in early trading Tuesday as investors celebrated <a href="http://digitaldaily.allthingsd.com/20091019/apple-beats-street/">another of the company&#8217;s great quarters</a>.</p>
<p>&#8220;We are very impressed by Apple’s ability to post a record profit quarter during difficult macro spending conditions,&#8221; Canaccord Adams analyst Peter Misek said in a note to clients this morning. &#8220;A host of new product introductions and continued traction with the iPhone give us confidence in the sustainability of Apple’s operating model.&#8221;</p>
<p>Suffice it to say, Misek wasn’t the only the analyst lauding Apple’s (AAPL) fourth-quarter performance. Below a selection of commentary from other Apple watchers:</p>
<p><strong>Gene Munster, Piper Jaffray</strong><br />
&#8220;September results were strong despite headwinds of iPhone production constraints and a Mac desktop offering in need of a refresh. We expect these headwinds to become tailwinds in the December quarter, which we believe will be positive for AAPL shares in the coming months.&#8221;</p>
<p> <strong>Mike Abramsky, RBC Capital Markets</strong><br />
&#8220;With strong financial performance and product uptake amidst recession, and further catalysts (iPhone in China, Tablet, refreshed iMacs, iPhone share gains/momentum), we foresee further upside for the shares.&#8221;</p>
<p><strong>Maynard Um, UBS</strong><br />
&#8220;Upside to virtually every metric in the qtr backs our positive view on Apple. We continue expect greater &#8220;recurring&#8221; iPhone hardware revenue (growing installed base &#038; stickiness of the App Store), which should drive more visibility into iPhone sales (20%+ of our FY10 iPhone shipments), as well as iPhone expansion driven by new partnerships (&#038; end of exclusivities). Longer term, we believe a service to provide seamless access &#038; mobility of digital content across all products may be the draw (halo) that drives additional future Apple product sales.&#8221;</p>
<p><strong>Tavis McCourt, Morgan Keegan</strong><br />
&#8220;Overall, Q4:09 was a strong quarter for Apple, as the Mac is nearly becoming the de facto computer for the back-to-school season. Additionally, iPhone trends remain remarkably strong, with unit economics holding up at unheard of levels in the wireless industry.&#8221;</p>
<p><strong>Yair Rainer, Oppenheimer</strong><br />
&#8220;As usual, Apple appears to be leaving plenty of room for upside surprises to both revenue and margins. On the revenue side, Apple should benefit from continued Mac momentum (particularly in Europe), higher recognized iPhone revenue, and some channel fill for both Mac and iPhone. Gross margin upside is likely to come from a higher proportion of recognized, high-margin iPhone revenue.&#8221;</p>

On Thursday, the chip maker reported <a href="http://phx.corporate-ir.net/phoenix.zhtml?c=74093&amp;p=irol-newsArticle&amp;ID=1342558&amp;highlight=">a narrower third-quarter loss</a> than projected, thanks to &#8220;strong demand&#8221; for its microprocessors and graphics chips. </p>
<p>Analysts had expected AMD to lose 42 cents a share on revenue of $1.26 billion, according to a consensus survey by Thomson Reuters. Instead, the company lost 18 cents a share on revenue of $1.4 billion, which was down from $1.8 billion for the same quarter last year.</p>
<p>Not the sort of <a href="http://digitaldaily.allthingsd.com/20091013/intel-profit-sales-beat-street/">blow-out quarter we saw from Intel</a> (INTC) earlier this week, but encouraging news nonetheless. Certainly, AMD’s leadership believes the company is poised for a turnaround. During a conference call to discuss AMD&#8217;s (AMD) third-quarter results, CEO Dirk Meyer offered an upbeat outlook for the remainder of 2009 despite the current loss. </p>
<p>&#8220;Third quarter consumer PC demand continued to improve from prior periods, with particular strength in notebooks and in China and continued recovery in Europe and in North America,&#8221; <a href="http://seekingalpha.com/article/166870-advanced-micro-devices-inc-q3-2009-earnings-call-transcript?page=-1">Meyer said</a>. &#8220;And it appears the commercial IT markets are positioned to improve next year&#8230;.Going forward, we believe we are well positioned to succeed.&#8221;</p>

Or it is in Google’s case anyway. </p>
<p>Reporting <a href="http://investor.google.com/releases/2009Q3_google_earnings.html">third-quarter results</a> after market close Thursday, Google (GOOG) topped estimates, posting net income that rose to $1.64 billion, or $5.13 a share, from $1.29 billion, or $4.06 a share in the same period last year. Net revenue for the period ended in September rose nearly one percent to $4.38 billion. Excluding items, earnings for the quarter were $5.89 a share. Consensus estimates had been calling for $5.42 a share and $4.24 billion in net revenue. The chart below shows revenue sources within Google (click to enlarge).</p>

<p>Impressive. Seems paid clicks grew 14 percent compared to the same period last year, and four percent compared to the prior period. Cost per click was down six percent year over year, but up five percent sequentially.</p>
<p>&#8220;Google had a strong quarter&#8211;we saw seven percent year-over-year revenue growth despite the tough economic conditions,&#8221; said CEO Eric Schmidt. &#8220;While there is a lot of uncertainty about the pace of economic recovery, we believe the worst of the recession is behind us and now feel confident about investing heavily in our future.&#8221;</p>
<p>Good to hear. Google’s shares, which have already risen more than 50 percent in the past six months, are on another upward tear. They rose 1.82 percent to $539.27 on the news in after-hours trading.</p>
<p><strong>Earnings call highlights via <a href="http://blogs.wsj.com/digits/2009/10/15/live-blogging-google-earnings-3/">The Wall Street Journal&#8217;s Andrew LaVallee</a>:</strong></p>

The cast is the same as last quarter: <a href="http://www.google.com/intl/en/corporate/execs.html#eric">Mr. Schmidt</a>, CEO; <a href="http://www.google.com/intl/en/corporate/execs.html#pichette">Patrick Pichette</a>, CFO; <a href="http://www.google.com/intl/en/corporate/execs.html#jonathan">Jonathan Rosenberg</a>, SVP of product management; and for the first time, <a href="http://www.google.com/intl/en/corporate/execs.html#nikesh">Nikesh Arora</a>, president of global sales operations and business development. But there&#8217;s a twist&#8211;they&#8217;ll be using Google&#8217;s moderator to vet questions with voters. They vote on &#8220;the most relevant questions,&#8221; which go to the Google execs, the operator says.</p>
<p>4:35: &#8220;While there&#8217;s obviously a lot of uncertainty about the pace of the economic recovery, we believe the worst of the recession is behind us,&#8221; Schmidt says.</p>
<p>He adds that Google now has the confidence to invest &#8220;heavily&#8221; in its future. &#8220;It&#8217;s all good news from our perspective, at least in looking at the quarter.&#8221;</p>
<p>4:37: Says &#8220;we want to really get to the perfect search engine&#8221; and that many advertisers would like to spend more with Google if the company&#8217;s product allow them to do that.</p>
<p>4:38: Schmidt says &#8220;we&#8217;re open for business in making strategic acquisitions, both large and small.&#8221;</p>
<p>4:39: It&#8217;s Pichette&#8217;s turn. &#8220;At a high level, we&#8217;re very pleased with our Q3 results,&#8221; he says. The quarter benefited from growth in AdSense for content and display initiatives.</p>
<p>4:41: U.S. revenue up 4% to $2.8 billion. U.K. revenue decline affected by foreign exchange as well as ongoing macroeconomic weakness, Pichette says.</p>
<p>4:42: Operating expenses rose from the prior quarter, mostly due to payroll, equipment and facilities-related expenses. </p>
<p>&#8220;We believe the worst of the recession is behind us,&#8221; he says.</p>
<p>4:44: Brazil was a standout in Latin America, Arora says. We&#8217;re beginning to see signs of recovery in Europe and Africa, particularly Spain. In Asia, China performed strongly as an emerging market.</p>
<p>4:46: Looking at the display-advertising business, those have also shown strong results, he says. </p>
<p>On YouTube, new advertisers and partners are helping with monetization efforts. Ninety percent of the top 50 advertisers have run YouTube campaigns with successful results&#8211;recent examples include McDonald&#8217;s and Hewlett-Packard.</p>
<p>4:47: YouTube has signed deals with all four major record labels and several independent labels. Earlier today, Google announced a partnership with Channel 4 in the U.K., which will bring full-length programming to the video-sharing site.</p>
<p>4:48: Arora adds a personal shout-out to the sales team.</p>
<p>4:50: Rosenberg calls the new AdWords front-end one of the company&#8217;s biggest investments of the year. Advertisers have new reports, can run more efficient campaigns and can get new features faster thanks to the platform, he says.</p>

At $524.24, they’re up 1.55 percent&#8211;nearly $8, and not without good reason. </p>
<p>This morning, Goldman Sachs (GS) and Bernstein both had good things to say about the company, noting that investors may have underestimated its potential for growth. &#8220;Discussions with advertising agencies, including a dinner we hosted with senior agency executives, point to rising spending on Google since June, led by travel, clothing and home improvement advertisers,&#8221; Goldman said in a research note issued this morning.</p>
<p>Bernstein analyst Jeffrey Lindsay was similarly bullish. &#8220;We expect Google&#8217;s results to show some signs of cyclical improvement in Q3, as easier comparisons and more favorable currencies should benefit topline trends,&#8221; he wrote in a research note. &#8220;Paid search is an early cycle advertising format given the immediacy of keyword auctions, and Google has maintained its dominant position within the category.&#8221;</p>
<p>Also bolstering Google (GOOG) shares today are the recent comments of company CEO Eric Schmidt, who told journalists at<a href="http://mediamemo.allthingsd.com/20091007/live-from-new-york-google-cofounder-sergey-brin-meets-the-press/"> a roundtable discussion last week</a> that the economy is starting to turn around. &#8220;The worst is behind us and we clearly see aspects of recovery, and what is notable is we&#8217;re seeing aspects of recovery not just in the United States but also in Europe,&#8221; Schmidt said. &#8220;We are increasing our hiring rate and our investment rate in anticipation of a recovery.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/10/4506VV4002-250x256.jpg" alt="" title="" width="250" height="256" class="alignright size-medium wp-image-26238" />It has been nearly eight years since the U.S. Department of Justice agreed to dissolve <a href="http://www.cptech.org/at/ibm/ibm1956cd.html">its 1956 consent decree with IBM</a>, lifting restrictions that had prevented the company from becoming a monopoly in the market for punch card tabulating and later, electronic data processing machines. </p>
<p>But perhaps those restrictions were better left in place. Because on Thursday, the DOJ opened a preliminary investigation into IBM’s business practices, seeking to determine if the company has abused its monopoly position in the mainframe market. The inquiry stems from a complaint filed by the Computer and Communications Industry Association that claims IBM (IBM) has undermined sales of competing mainframe hardware products by refusing to license its mainframe operating system and certain other intellectual property.  </p>
<p>&#8220;IBM has used its power to resurrect and create a formidable set of barriers in the mainframe market by their misuse of intellectual property,&#8221; <a href="http://www.nytimes.com/2009/10/08/technology/companies/08antitrust.html">CCIA CEO Edward J. Black, told the New York Times</a>. &#8220;Once IBM walls are taken down by the government enforcing the law, there will be a rush of people looking to get part of this marketplace.&#8221;</p>
<p>Perhaps. Certainly that’s not really the case now. As the CCIA and T3 Technologies&#8211;which <a href="http://www.t3t.com/pdf/11_26_07_ibm_litigation.pdf">filed an antitrust complaint against IBM in Europe earlier this year for similar reasons</a>&#8211;would argue, IBM has essentially left the industry with a single mainframe vendor: itself. And if that sounds like an exaggeration, consider this: A few years back, a company called Platform Solutions attempted to license IBM&#8217;s mainframe software. IBM refused and then sued Platform, accusing it of a raft of IP-related violations. Platform countersued. And then, in 2008, <a href="http://www.forbes.com/feeds/afx/2008/07/02/afx5177720.html"> IBM acquired the company</a> and promptly shut down its operations.</p>
<p>&#8220;For decades, IBM licensed its system software and intellectual property to other computer manufacturers,&#8221; T3 president Steven Friedman said earlier this year. &#8220;However, for no reason other than to remove all competition from the mainframe market, IBM eliminated programs to allow customers to buy its mainframe software for use on non-IBM mainframe solutions&#8230;.[Now] only IBM&#8230;offers IBM- compatible mainframes and, based on IDC reports, controls over 99% of all existing IBM-compatible mainframes in use today.&#8221;</p>

This morning, the EC <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/09/439&amp;format=HTML&amp;aged=0&amp;language=EN&amp;guiLanguage=en">announced</a> a <a href="http://ec.europa.eu/competition/antitrust/cases/decisions/39530/market_test_notice.pdf"> market test of the browser ballot feature</a> Microsoft plans to include in Windows 7. If it’s successful, the feature will become standard in European versions of Windows and resolve the ongoing antitrust case in which the EC accused the American firm of abusing its Windows monopoly.</p>
<p>&#8220;I’m absolutely of the opinion that this is a trustful deal that we’re making. I trust Microsoft,&#8221; Competition Commissioner Neelie Kroes said during a press conference this morning. &#8220;There can’t be a misunderstanding. Here is the final result of a long discussion over a long period.&#8221;</p>
<p>Microsoft (MSFT) was equally upbeat on the EC’s decision. &#8220;We welcome today’s announcement by the European Commission to move forward with formal market testing of Microsoft’s proposal relating to web browser choice in Europe,&#8221; General Counsel Brad Smith said in a statement. &#8220;We also welcome the opportunity to take the next step in the process regarding our proposal to promote interoperability with a broad range of our products.&#8221;</p>
<p>There were, however, a few that were not so welcoming of the move. Top among them, ECIS, an industry group whose members include Oracle (ORCL), Sun (JAVA), IBM (IBM) and Nokia (NOK). &#8220;ECIS notes that the settlement does not appear to deal with the inadequacies of Microsoft&#8217;s standards compliance, unfair pricing practices or other concerns related to patent abuse or standards manipulation,&#8221; the group said in a statement.</p>

<p>The unit boasts 14 different tuners compared with the typically high-end set, which has about three. Its speakers are reportedly comparable to those of a high-end stereo system, and with its Cell chip and image-processing technology, it is capable of improving the resolution of a crappy YouTube video to near high-definition quality. Finally, in addition to displaying eight high-def broadcasts at once, the TV can record them&#8211;simultaneously. Oh, it can time-shift them if you’d like, too.<br />

<p>$11,115? For a TV? In this recession? When TV prices are declining?</p>
<p>Damn right. And Toshiba expects to sell about 1,000 of them a month in Japan before bringing them to market in the U.S. and Europe in 2010. </p>

<p>To wit, Google’s announcement Monday of <a href="http://news.bbc.co.uk/2/hi/technology/8242710.stm">a number of concessions to the European Union</a>, which seems a bit dubious of the whole thing. In a letter to several publisher associations in Europe, the company invited two non-U.S. representatives to join the board that will oversee the book rights registry that is to distribute royalties from digital book sales under terms proposed by the settlement. The company also promised to seek their permission before digitally publishing European works still protected by copyrights. </p>
<p>&#8220;Books that are commercially available in Europe will be treated as commercially available under the Settlement,&#8221; Google (GOOG) explained. &#8220;Such books can only be displayed to US users if expressly authorised by rights holders.&#8221;</p>
<p>Quite a concession, given Google’s plans to create a so-called &#8220;last library,&#8221; but clearly necessary with opposition to the deal abroad so pronounced. Already, <a href="http://www.reuters.com/article/technologyNews/idUSN0149201520090901?sp=true">Germany has filed an objection to it</a>, saying the agreement would &#8220;irrevocably alter the landscape of international copyright law.” And now <a href="http://www.reuters.com/article/rbssTechMediaTelecomNews/idUSL725081620090907">France is about to do the same</a>. </p>
<p>&#8220;Google will have a monopoly digitalising European orphan works without permission,&#8221; Nicolas Georges, director for books and libraries at the French Culture Ministry, told Reuters. &#8220;Google has the power to determine which work will be in its database or not. For example, some works that are not commercial may be removed by Google.&#8221;</p>
<p>Seems Google&#8217;s effort to establish a de facto worldwide copyright regime isn&#8217;t going to be quite as easy as the company had hoped.</p>

<p>It is an extraordinary market play. And an unsettling one. For it seeks to place Google (GOOG), which already collects vast amounts of data about our Internet use, at the very center of our information experience. </p>
<p>The privacy implications are, of course, horrendous. And while Google will inevitably <a href="http://www.google.com/privacy.html">dismiss such concerns as paranoid</a> and argue that any data the company might collect at the OS level will be used only to improve its services and benefit users, it should still give us all pause. Because when it is finally launched, Chrome OS will be yet one more deep well of consumer data to which Google will have access. </p>
<p>There are already quite a few such wells, including Google Search and Chrome, that profile user interests and surfing habits: Gmail, which gives the company access to our email conversations, and Google Voice, which gives the company access to our spoken ones. Add to this Google Street View and Latitude, a service that tracks the physical location of its users, and mobile and desktop operating systems and, well&#8230;that kind of consolidation of Internet-based services around a single dominant company should give us all pause.</p>
<p>Lest we forget, <a href="http://www.nytimes.com/2009/03/11/technology/internet/11google.html">Google <em>is</em> in the behavioral targeting business</a>.  Why would people ever use an OS developed by a company whose business is based on meticulously recording and analyzing their online behavior? Because they enjoy using its other services, I suppose. But there is a privacy-vs-ease-of-use tradeoff here. And with Chrome OS, it is unprecedented. Further, while Google might tout its &#8220;don&#8217;t be evil&#8221; motto as reason enough to trust the company with our data, there are other entities that don&#8217;t always share that sensibility. Remember, it wasn’t so long ago that <a href="http://blogs.siliconvalley.com/gmsv/2006/01/what_if_we_prom.html">the federal government tried to force Google to turn over user search data to the Justice Department</a>&#8230;</p>
<p>&#8220;Competition in the OS market should always be welcome, but Google is the special case,&#8221; Marc Rotenberg, executive director of the Electronic Privacy Information Center, told Digital Daily. &#8220;It has become dominant across many essential Internet services&#8211;search, mail, video, online apps, and advertising. Coupled with Google&#8217;s growing profiles of American consumers and reluctance to adopt meaningful privacy safeguards, we expect that antitrust authorities in the US and Europe will view Google&#8217;s entry into the OS market with enormous skepticism.&#8221;</p>
<p>Jeff Chester, executive director of The Center for Digital Democracy, echoed Rotenberg&#8217;s concerns. &#8220;Google&#8217;s new OS has to be placed under the data collection X-Ray by US and EU privacy regulators and advocates,&#8221; he said. &#8220;Any expansion into the marketplace by either Google or Microsoft should generate intense scrutiny, especially for the privacy implications. These two are engaged in a global data collections digital arms race, which has far-reaching implications for consumers and their information.&#8221;</p>
