			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/dellephone.jpg" alt="dellephone" title="dellephone" width="200" height="200" class="alignright size-full wp-image-28941" />After nearly three years of rumor and speculation, <a href="http://content.dell.com/us/en/corp/d/press-releases/2009-11-13-dell-confirms-smart-phone-plans.aspx?c=us&amp;l=en&amp;s=gen">Dell is finally entering the smartphone market</a>&#8211;in China and Brazil. Later this month, China Mobile and Brazil’s Claro will begin selling the company’s Mini 3, a handset designed around Google&#8217;s (GOOG) Android mobile operating system. </p>
<p>Why China and Brazil? Well, for one thing, they are developing markets. For another, Dell (DELL) already has partners there. </p>
<p>&#8220;Besides size (China Mobile has over 500 million subscribers, and Claro serves more than 42 million), we have existing telecom partnerships with them,&#8221; Dell blogger Lionel Menchaca said in a post. &#8220;Back in April, we were the first to embed China Mobile’s technology into our Mini 10 netbook. And if you’ve been watching, you know Dell has agreements with lots of other providers like Vodafone in Europe, Australia and New Zealand. We’ve partnered with AT&#038;T and Verizon in the United States to offer mobile broadband on different products, and we have agreements with other carriers in Asia.&#8221;</p>
<p>Interesting. Presumably this means we’ll see the Mini rolled out in short order in these other countries as well. As you may recall, <a href="http://digitaldaily.allthingsd.com/20091007/dellephone-headed-to-att/">Dell was rumored to be building an Android handset for AT&#038;T (T) in early October</a>.</p>

This morning it unveiled an expanded online store that will better reflect its new real-world counterpart.</p>
<p>&#8220;On the new online Microsoft Store, we’ve added a bunch of new products, including Windows 7 PCs as well as select 3rd party software and accessories,&#8221; <a href="http://trevinchow.com/blog/2009/10/21/the-new-microsoft-store-launches-with-windows-7/">Trevin Chow, senior lead program manager for Microsoft Store, said in a blog post announcing the move</a>. &#8220;And let’s not forget a ton of gaming products that have been added including a bunch of the top selling Xbox 360 titles.&#8221;</p>
<p>Interesting. Not exactly sure what the upside is to selling PCs online when you don&#8217;t make them. It&#8217;s not like Microsoft (MSFT) will be offering a better experience than, say, Best Buy (BBY), HP (HPQ) or Dell (DELL). And an online outlet doesn&#8217;t afford the company the same opportunity to cultivate the &#8220;Microsoft Experience&#8221; it&#8217;s clearly going for in its brick-and-mortar outlets. So why bother? </p>
<p>A unified experience online and off, I suppose. And, if the infrastructure is in place to sell through one channel, why not sell through both? Of course, the downside is that if you don&#8217;t execute well, you risk giving customers another lousy experience with which to associate your products.</p>

			<content:encoded><![CDATA[<p>There was more truth than braggadocio to Acer President Gianfranco Lanci’s claim earlier today that his company would soon <a href="http://digitaldaily.allthingsd.com/20091014/stroker-acer/">overtake Dell as the second-largest PC maker in the world</a>. Because according to new reports from both <a href="http://www.gartner.com/it/page.jsp?id=1207613">Gartner</a> and <a href="http://www.reuters.com/article/pressRelease/idUS194969+14-Oct-2009+BW20091014">IDC</a>, Acer is indeed the No. 2 producer of PCs in the world. </p>
<p>Gartner (IT) figures Acer sold 12.5 million PCs in the quarter, a year-over-year increase of 23.6 percent from last-year&#8217;s third quarter and 15.4 percent of the global market. By contrast, it says Dell (DELL) sold 10.3 million PCs&#8211;6.7 percent fewer than it sold a year ago&#8211;for a 12.8 percent market share. Meanwhile, IDC pegs Acer at 14 percent global market share and Dell at 12.7 percent. </p>
<p>Both research houses put Hewlett-Packard (HPQ) on top, with Gartner showing the company at 19.9 percent of PCs shipped and IDC at 20.2 percent.</p>

That’s how long it’s going to take Acer to surpass Dell in market share. Speaking at a news conference in London, company President Gianfranco Lanci took a few moments to talk a bit of smack about his rivals. &#8220;We don&#8217;t expect revenue to decline this year, which is outstanding, compared to our competitors. Therefore, we&#8217;re [expecting] good growth in 2010 again,&#8221;<a href="http://online.wsj.com/article/SB10001424052748704107204574472863992091306.html"> Lanci said</a>. &#8220;Between this quarter and the next, we can finally pass Dell&#8221; (DELL).</p>
<p>And once Acer does that, Hewlett-Packard (HPQ)&#8211;the world’s largest PC maker by shipments&#8211;best start watching its back. Said Lanci: &#8220;I would expect not only to pass Dell very soon, but also to breach the gap with HP.&#8221;</p>
<p>Have Acer&#8217;s buyouts of Gateway and Packard Bell gone to Lanci’s head? Perhaps just a little. That said, the company has seen quite a bit of growth thanks to the netbook phenomenon, which shows no signs of abating. </p>

<p>&#8220;You will see us be reasonably active,&#8221; he said. &#8220;We have a talented team of people that includes people who have been at Dell a long time and understand the Dell culture in the transactions that we’ve done and know why those have succeeded or not. We are rapidly developing that, and we’ve added some talent to help us do that.&#8221;</p>
<p>And what sectors is Dell (DELL) most interested in? Health-care information technology, as the Perot acquisition clearly suggests. &#8220;When you look at the health-care space, it’s the one sector of the economy that has the least amount of IT, and we see it as very promising for growth,&#8221; Dell said. &#8220;There’s usually more technology at the grocery store than there is at your doctor’s office.&#8221;</p>

On Wednesday, the PC maker said <a href="http://www.charlotteobserver.com/business/story/990134.html">it would close its plant in Winston-Salem, N.C.</a>, as part of a long-term restructuring that will see it cut costs by $4 billion by the end of fiscal 2011. Over 900 employees will lose their jobs as a result.  </p>
<p>&#8220;This was a difficult but necessary decision to improve the company&#8217;s competitive position,&#8221; Dell (DELL) spokesman David Frink said. &#8220;It is not a commentary on workers in North Carolina or workers in the United States.&#8221; </p>
<p>Of course not. As Dell CFO Brian Gladden said <a href="http://seekingalpha.com/article/158737-dell-inc-f2q-2010-qtr-end-07-31-09-earnings-call-transcript?page=-1">during the company’s last earnings call</a>, &#8220;Our cost reduction programs have never been more crucial than during this weaker demand environment.&#8221; </p>
<p>Still, it’s unfortunate to see the company forced to shift work once done in the states to lower-cost contract manufacturers abroad. This is, after all, Dell’s third big closure in recent memory. The company stopped desktop manufacturing in Lebanon, Tenn., earlier this year, and in 2008, it shuttered a desktop plant in Austin, Texas.</p>

<p>While this might seem optimistic for an OS that is found on less than two percent of all smart phones today, it’s not entirely unreasonable given the distribution deals Google (GOOG) has been lining up. Yesterday, the search giant announced <a href="http://digitaldaily.allthingsd.com/20091006/google-and-verizon-to-co-develop-android-devices-and-services/">a deal to bring Android-based devices to Verizon Wireless</a> (VZ). Now comes word that <a href="http://online.wsj.com/article/SB10001424052748703298004574459380459235704.html">Dell (DELL) is building an Android handset for AT&#038;T</a> (T). People briefed on the companies&#8217; plans tell The Wall Street Journal that the device is <a href="http://digitaldaily.allthingsd.com/20090817/dellephone-debuts-in-china/">similar to the one the PC marker has been showing off in China</a> and is scheduled to hit the market sometime in early 2010.</p>

First <a href="http://digitaldaily.allthingsd.com/20090921/dell-to-acquire-perot-systems-for-3-9-billion/">Dell (DELL) buys Perot Systems</a> (PER) for $3.9 billion. Then<a href="http://voices.allthingsd.com/20090928/xerox-pays-6-4b-for-acs-in-cash-and-stock-xrx-down-12-percent/"> Xerox (XRX) purchases Affiliated Computer Services</a> (ACS) for $6.4 billion. Now <a href="http://newsroom.cisco.com/dlls/2009/corp_093009.html">Cisco is acquiring Tandberg</a>.</p>
<p>Cisco (CSCO) will pay nearly $3 billion in cash for the Norwegian videoconference company, which it hopes will bolster its position in videoconferencing. The offer values Tandberg at 11 percent more than its closing price in Oslo trading yesterday and at about 23 times 2010 earnings.  But the company’s lower-end TelePresence systems and specialized software for managing teleconferences will do much to help Cisco dominate the $34 billion collaboration market. </p>
<p>It&#8217;s worth noting that earlier this year, Gartner (IT) forecast that video telepresence could replace 2.1 million business travel flights a year by 2012, <a href="http://www.greentelecomlive.com/2009/02/09/gartner-video-conferencing-to-carve-us35b-a-year-from-travel-by-2012/">diverting $3.5 billion annually from the airline industry</a>.</p>
<p>&#8220;This fits very well with Cisco,&#8221; <a href="http://www.bloomberg.com/apps/news?pid=20601103&amp;sid=azoVNS0pcXxU">Robeco NV’s Michiel Plakman told Bloomberg</a>. &#8220;They will immediately become the most important player in the market and aren’t paying a ridiculous premium, so this is positive.&#8221;</p>
<p>Cisco&#8217;s tender offer has the recommendation of the Tandberg board and is expected to close in the first half of next year.</p>

The EC today responded to <a href="http://digitaldaily.allthingsd.com/20090916/the-ec-pay-intel’s-legal-expenses-uh-good-luck-with-that-one/">Intel’s claims that the Commission&#8217;s antitrust ruling against the company was meted out in error</a> by releasing <a href="http://ec.europa.eu/competition/sectors/ict/intel.html">the full text of its decision</a> and  <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/09/400&amp;format=HTML&amp;aged=0&amp;language=EN&amp;guiLanguage=en">a selection of email correspondence and internal memos</a> that make it clear that Intel (INTC) probably should have kept its big mouth shut. </p>
<p>&#8220;There have been some suggestions that the decision was based on allegations and not facts,&#8221; said Jonathan Todd, a commission spokesman. &#8220;With the publication of this decision, you can see precisely the details of the facts and how Intel broke the law.&#8221;</p>
<p>Below, a few of those details:</p>
<blockquote class="memo"><p>
<strong>From a  series of 2006 Lenovo e-mails:</strong><br />
&#8220;As you know I have been negotiating a special deal with Intel. The net is that Intel has made us a very attractive offer that we will end up taking. Our part of this deal is that we will award all business of shipments for the rest of this calendar year to Intel. In exchange, Intel will give us a special deal for both [geographical area] and [geographical area]. The deal is worth millions of dollars.&#8221;</p>
<p>&#8220;[two Lenovo executives] had a dinner with [an Intel executive] tonight (…). […] When we asked Intel what level of support we will get on NB [notebook] in next quarter, [he] told us (…) the deal is base[d] [sic] on our assumption to not launch AMD NB [notebook] platform. (…) Intel deal will not allow us to launch AMD.&#8221;</p>
<p><strong>From a  2002 HP e-mail concerning the company’s negotiation of a rebate agreement with Intel:</strong><br />
&#8220;PLEASE DO NOT&#8230; communicate to the regions, your team members or AMD that we are constrained to 5 percent AMD by pursuing the Intel agreement.&#8221;</p>
<p><strong>From a 2004 HP e-mail:</strong><br />
&#8220;You can NOT use the commercial AMD line in the channel in any country, it must be done direct. &#8220;If you do and we get caught (and we will) the Intel moneys (each month) is gone (they would terminate the deal). The risk is too high.&#8221;</p>
<p><strong>From a 2004 Dell e-mail:</strong><br />
&#8220;[Intel senior executives] are prepared for [all-out war] if Dell joins the AMD exodus. We get ZERO MCP for at least one quarter while Intel ‘investigates the details’ (…) We’ll also have to bite and scratch to even hold 50%, including a commitment to NOT ship in Corporate. If we go in Opti [Optiplex corporate desktop line], they cut it to <20% and use the added MCP to compete against us" and "It looks 100% certain that Intel will take MCP to ZERO for at least one quarter while they 'review all of the numbers and implications.' (...) Appears likely that Intel would take MCP to <25% of current levels UNLESS we agree up front not to ship into [Product line]. If we do that, we're in 'détente' mode and can keep MPC [sic] at 50%. However, we don't meet [AMD Senior Executive]'s T&#038;Cs [Terms and Conditions]. So, I would plan on MCP at <20% levels if we execute AMD across [Product line]and [Product line] as AMD wants."
</p></blockquote>
<p>Sounds pretty damning, no? Well, Intel doesn’t think so. In a hastily issued response, the company dismissed the EC’s release of the documents saying, &#8220;there’s nothing new here.&#8221;</p>
<p>&#8220;This Decision reflects the underlying bias we have come to expect from the case team that ran this investigation,&#8221; Intel said. &#8220;The Commission relied heavily on speculation found in e-mails from lower level employees that did not participate in the negotiation of the relevant agreements. At the same time, they ignored or minimized hard evidence of what actually happened, including highly authoritative documents, written declarations and testimony given under oath by senior individuals who negotiated the transactions at issue.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/09/DudeYoureGettingPerot.jpg" alt="" title="" width="216" height="177" class="alignright size-full wp-image-25125" />David Johnson,  <a href="http://www.informationweek.com/news/showArticle.jhtml?articleID=217700367">the mergers-and-acquisitions specialist Dell hired away from IBM</a> (IBM) earlier this year, has clearly been busy these past few months. This morning the PC maker announced plans to buy information technology services outfit Perot Systems (PER) for about $3.9 billion. Under the terms of the deal, Dell (DELL) will offer $30 a share for Perot, a 68 percent premium over Friday&#8217;s closing price Friday of $17.91. </p>
<p>&#8220;This significantly expands Dell’s enterprise-solutions capabilities and makes Perot Systems&#8217; strengths available to even more customers around the world,&#8221; <a href="http://content.dell.com/us/en/corp/d/secure/2009-09-21-Perot-Systems.aspx">Dell CEO Michael Dell said in a statement</a>. &#8220;There will be efficiencies from combining the companies, but the acquisition makes such great sense because of the obvious ways our businesses complement each other.&#8221; </p>
<p>The deal is expected to close some time in January and when it does, Perot will become Dell&#8217;s services unit.</p>
<p>An interesting move. While there had been speculation that Dell was looking to acquire a handset company like Palm (PALM), it seems Dell was far more interested in boosting its enterprise business by acquiring an outsourcer like Perot.</p>

In <a href="http://www.oracle.com/features/suncustomers.html">a full-page ad</a> published in The Wall Street Journal today, the database giant made a very public commitment to all of them and told customers there’s no reason to consider jumping ship for IBM. &#8220;We&#8217;re in it to win it,&#8221; Oracle CEO Larry Ellison boasts in the ad. &#8220;IBM, we&#8217;re looking forward to competing with you in the hardware business.&#8221;</p>

<p>Welcome news for Sun (JAVA) engineers worried they might lose their jobs as a result of Oracle’s (ORCL) surprise acquisition of the company. Bad news for rivals like Dell (DELL), HP (HPQ), and, of course, IBM (IBM). Clearly, Oracle plans to make their lives a lot more difficult.</p>
