			<content:encoded><![CDATA[<p>Add another voice to the cacophony around net neutrality: Qualcomm’s. Speaking at the CTIA wireless industry conference in San Diego Thursday, Qualcomm CEO Paul Jacobs warned of a looming crisis in wireless capacity and <a href="http://www.reuters.com/article/technologyNews/idUSTRE59760F20091008">said it must be met with some form of traffic shaping</a>. </p>
<p>&#8220;It’s very obvious that we are pushing the limits of the amount of capacity we have,&#8221; Jacobs said, adding that network neutrality regulations <a href="http://www.ft.com/cms/s/0/7226851c-b468-11de-bec8-00144feab49a.html">should not restrict operators&#8217; ability to manage their networks</a>. </p>
<p>&#8220;Operators should have the ability to say: &#8216;let’s be fair, this person’s moved a lot of data, this person’s used a little’, if they’re paying the same amount, then the person who’s used less will get more access&#8230;.We are on the side of, yes, you have to be able to do something to manage your network, but it&#8217;s not the right thing to go in and say one service or another is OK.&#8221;</p>
<p>In other words, Qualcomm (QCOM) favors usage-based throttling. In theory, this should ensure that all customers get their fair share of bandwidth every hour of the day. In practice, however, <a href="http://digitaldaily.allthingsd.com/20080225/comcast-2/">it has meant something else entirely.</a> So the question remains: If data traffic is to be shaped (and I am <em>not</em> saying that it should be), who will determine how it will be shaped and, more importantly, who can be trusted to make that determination fairly?</p>
<p>Jacobs&#8217;s remarks come a day after Federal Communications Commission Chairman Julius Genachowski reiterated the Obama administration&#8217;s call for network neutrality.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/07/547896104_urhkw-l-200x300.jpg" alt="" title="" width="200" height="300" class="alignright size-medium wp-image-21773" />Six years after <a href="http://www.fool.com/investing/general/2003/09/09/death-to-ebooks.aspx">shuttering its first e-book effort</a>, Barnes &#038; Noble has embarked on a new one. Monday afternoon, the bookseller announced what it describes as  <a href="http://www.barnesandnobleinc.com/press_releases/2009_july_20_ebookstore.html">&#8220;the world&#8217;s largest eBookstore,&#8221;</a> an online storefront that boasts 700,000 titles. </p>
<p>That’s substantially more than the 300,000 available for download on Amazon&#8217;s Kindle service, though half-a-million of them are public-domain books provided by Google (GOOG). They’ll be compatible with Apple’s (AAPL) iPhone and iPod touch, BlackBerry smartphones, and, when it finally arrives at market, the Plastic Logic eReader, a Kindle DX-size e-book reader for which the Barnes &#038; Noble eBookstore will be the exclusive storefront. </p>
<p>&#8220;Today marks the first phase of our digital strategy, which is rooted in the belief that readers should have access to the books in their digital library from any device, from anywhere, at any time,&#8221; said BN.com president William J. Lynch.</p>
<p>With a few noteworthy exceptions, of course. E-books sold by Barnes &#038; Noble (BKS) won&#8217;t be compatible with Sony’s (SNE) Sony Reader Digital Book or Amazon&#8217;s (AMZN) Kindle, which they are clearly intended to undermine.</p>
<p>To what degree they’ll manage that is <a href="http://blogs.zdnet.com/BTL/?p=21365">anyone’s guess</a>. One thing is sure: We’ll almost certainly be seeing an e-book price war in the near future. And when Apple finally gets around to uncrating that <a href="http://digitaldaily.allthingsd.com/20090311/apple-netbook-actually-an-e-book/">tablet/e-reader device it’s been working on</a>, all bets are off.</p>

It doesn’t require a great feat of augury to see that an agreement between the two&#8211;at least at this time&#8211;isn’t that likely, as a number of analysts have recently noted. &#8220;In our view, the likelihood of a Microsoft-Yahoo search deal has gone down materially in recent weeks,” Collins Stewart analyst Sandeep Aggarwal  wrote in a research note to clients today. “The Bid/Ask spread for the deal remains the single biggest hurdle followed by some disagreement on operational aspects/deal structure, in our view. We believe that a  Microsoft-Yahoo search deal can happen but we are reducing the probability from 80%+ to 50%, and with the lowered probability, we restrain ourselves in terms of assigning any timeline.”</p>
<p>So, a 50-50 chance for a deal. Sounds about right, with Carol Bartz the wild card that could swing the odds as quickly and easily as she drops the F-bomb and with Microsoft as the desperate gambler looking to win back the deed to the search market it lost. Said Citi’s Mark S. Mahaney, “Although we view the likelihood of a major transaction as unlikely near-term, we continue to view Yahoo as the only logical long-term acquisition target for any company seeking scale in Internet advertising.”</p>

Now we know why it was <a href="http://d7.allthingsd.com/20090528/d7-interview-jon-rubinstein-and-roger-mcnamee-and-the-palm-pre/">Palm executive chairman Jon Rubinstein and investor Roger McNamee</a> on stage at <strong>D</strong> last month talking up the Pre, and not CEO Ed Colligan: Colligan was on his way out.</p>
<p>On Wednesday, Palm (PALM) named <a href="http://investor.palm.com/releasedetail.cfm?ReleaseID=389058">Rubinstein as its new chairman and CEO</a>. Come Friday he’ll succeed Colligan, who is leaving the company after 16 years to join McNamee at Elevation Partners.  Apparently Palm, who recruited Rubinstein, a former Apple (AAPL) engineer, to turn the company around has decided it would much rather have him in its highest office than Colligan under whose leadership it was foundering.</p>
<p>In a statement, Rubinstein&#8211;who has spent the past two years quarterbacking the development of the Pre and its webOS&#8211;welcomed his new role. &#8220;I am very excited about taking on this expanded role at Palm,&#8221; he said. &#8220;Ed and I have worked very hard together the past two years, and I&#8217;m grateful to him for everything he&#8217;s done to help set the company up for success. With Palm webOS we have ten-plus years of innovation ahead of us, and the Palm Pre is already one of the year&#8217;s hottest new products. Due in no small part to Ed&#8217;s courageous leadership, we&#8217;re in great shape to get Palm back to continuous growth, and we plan to keep the trajectory going upward.&#8221;</p>
<p>Reached for comment late Wednesday afternoon, Roger McNamee offered up this rather canned statement on Palm&#8217;s leadership transition: “With Ed’s decision to step down, Jon Rubinstein is the natural choice to lead Palm into its next phase of growth.  Jon has proven to have exactly the right mix of product vision, organizational leadership and operational capabilities to help Palm regain a leadership position. We are grateful for the leadership role Ed has played in initiating this transformation and getting through the successful launch of webOS and the Pre.&#8221;</p>
<p><a href="http://www.google.com/finance?q=palm">Palm shares</a> are up 3.75 percent at $12.44 on the news.</p>

<p>Java has a new evangelist: Oracle CEO Larry Ellison. </p>
<p>In his first public comments since announcing the Oracle (ORCL) acquisition of Sun Microsystems (JAVA) in April, Ellison told attendees of Sun&#8217;s annual JavaOne conference that <a href="http://www.eweek.com/c/a/IT-Infrastructure/Ellison-Oracle-Will-Continue-to-Invest-Heavily-in-Java-710187/">he plans to continue promoting it</a>.</p>
<p>&#8220;[Oracle] has invested more than anybody else in Java technology in terms of dollars over the years, and we intend to invest&#8211;and accelerate our investments&#8211;going forward,” <a href="http://blogs.zdnet.com/BTL/?p=19088">he said</a>, responding to concerns that this, the 14th JavaOne conference, might be Sun&#8217;s last. &#8220;I don&#8217;t expect a lot of changes, just expanded investment and a lot of enthusiasm coming from Oracle.”</p>
<p>Enthusiasm, indeed. Ellison clearly has big expectations for Java which he sees being used in consumer products such as netbooks or mobile devices. &#8220;I&#8217;m reading a lot in the newspaper about devices based on Java that are Android devices, which is very exciting,&#8221; he said. &#8220;And there are going to be net-netbooks based on Android. And I think &#8230; we can see lots and lots of Java devices, some coming from our friends at Google. But I don&#8217;t see why some of those devices shouldn&#8217;t come from Sun-Oracle. &#8230; So I think you&#8217;ll see us get very aggressive with Java and developing Java apps for things like telephones &#8230; and netbooks. <p>Microsoft’s new search engine <a href="http://www.bing.com/">Bing</a>&#8211;which <a href="http://d7.allthingsd.com/20090528/d7-interview-steve-ballmer/">debuted at our <strong>D7</strong> conference last week</a>&#8211;unexpectedly went live this morning ahead of its scheduled June 3 launch date and it’s already done much to distinguish itself from Microsoft’s previous efforts in search.</p>
<p>Certainly, there’s far more verb potential in Bing than “Microsoft Live Search,” the service it’s replacing. And&#8211;beyond all this <a href="http://twitter.com/loic/status/1988561701">silliness</a> about Bing’s<a href="http://www.techcrunch.com/2009/06/01/badda-bing-indeed/"> prowess in adult entertainment queries</a> (ever tried a similar search in Google (GOOG) or Yahoo (YHOO)?)&#8211;there’s a lot to impress. Bing is fast&#8211;very fast, actually. Its local results are robust, accurate and usable.</p>
<p><a href="http://www.bing.com/local/default.aspx?what=pizza&#038;where=94117&#038;s_cid=ansPhBkYp01&#038;mkt=en-us&#038;ac=false&#038;q=pizza%20near%2094117">This search for “pizza near 94117,”</a> for example, returns not just a list of pizza parlor homepages, but phone numbers, directions, reviews, coupons and bird’s eye maps as well. Video search is deep and the ability to further calibrate it by length, screen size and resolution is a nice touch. It offers <a href="http://www.discoverbing.com/mobile/411/">a 411 service</a> similar to Google&#8217;s.</p>
<p>And it’s UI is sleek, although the choice of hot air balloon background is begging for a wisecrack. There’s plenty of hot air in Microsoft’s claim that Bing is a &#8220;decision engine, designed to empower people to gain insight and knowledge from the Web, moving more quickly to important decisions.&#8221; That said, the engine does seem to be delivering, at least initially, on that promise.</p>
<p>Question is: Can Bing boost Microsoft&#8217;s market share in search from the mid-single digits to something more respectable?</p>

Apparently, the answer to Microsoft’s (MSFT) many search problems. As <a href="http://digitaldaily.allthingsd.com/20090519/microsoft-to-debut-new-search-at-d-all-things-digital/">we previously reported</a>, the software behemoth plans to debut its new search service at our <b>D: All Things Digital</b> conference later this week, and when it does it may have a new name.</p>
<p><a href="http://adage.com/digital/article?article_id=136847">Reports claim</a> that Microsoft Live Search, once known as Windows Live Search and, prior to that as MSN Search, will henceforth be known as&#8230;</p>
<p>Bing.</p>
<p>Which is <a href="http://kara.allthingsd.com/20090421/would-microsofts-new-search-name-smell-as-sweet-if-it-were-named-after-a-cherry-or-the-sopranos/">pretty much what we’ve expected all along</a>. Just what form Bing will take is another matter entirely. Will it simply be Live Search updated and recast? Or will it involve something more? Like perhaps that <a href="http://kara.allthingsd.com/20090526/wwyd-what-will-yahoo-do-deal-sell-stand-pat-or-what/">long-rumored deal with Yahoo</a> (YHOO) BoomTown&#8217;s been talking about? Or what if, ZDNet’s Mary Jo Foley speculates, “Microsoft and Yahoo announce some kind of jointly-managed company that will trade ad sales for search engine placement. This &#8216;MicroHoo&#8217; won’t be a merged Microsoft-Yahoo. Instead it will be some kind of ad/search entity.” What if, indeed. We may find out later this week.</p>
<p><b>UPDATE:</b> Interesting. <a href="http://blogs.zdnet.com/BTL/?p=18645">ZDNet’s Larry Dignan points to a report from Jeffries analyst Katherine Egbert</a> that suggests Microsoft is indeed preparing for some sort of joint venture or acquisition. A quick excerpt:</p>
<blockquote><p>&#8220;It&#8217;s also possible that Microsoft could debut a partnership or make an acquisition of some type that will bolster its online search presence. The software giant registered an LLC Corp. in Delaware last week, a move often made in advance of acquisitions or joint ventures. The registration gave rise to widespread speculation that Microsoft would acquire Citrix since the name of the LLC is somewhat similar to Microsoft&#8217;s code name for Citrix. While that&#8217;s possible, the timing of the registration and recent debt raise indicate that it might be more likely Microsoft uses the LLC to form a partnership that will boost the amount of traffic flowing through its search engine, perhaps through a partnership with Yahoo! or others.&#8221;</p></blockquote>

And this is precisely what Sprint CEO Dan Hesse did for the Palm Pre Tuesday. Speaking at J.P. Morgan&#8217;s Global Technology, Media and Telecom Conference shortly after Sprint announced the handset’s street date, Hesse said he anticipates that supplies will be limited, at least initially. “We don&#8217;t intend to advertise it heavily early on because we think we are going to have shortages for a while,&#8221;<a href="http://www.reuters.com/article/ousiv/idUSTRE54I2EN20090519"> Hesse said</a>. &#8220;We won&#8217;t be able to keep up with demand for the device in the early period of time.&#8221; </p>
<p>Interesting thing to say in advance of a product launch on which so much is riding, don’t you think? Unless you’re already trying to foster the perception of excess demand. As <a href="http://www.bloomberg.com/apps/news?pid=newsarchive&amp;sid=az5nzqH0Mt4M">Gartner analyst Hugues De La Vergne noted last month</a>, “It’s important to have a success like selling out. The Pre has to live up to the hype or else they’ll lose their momentum to rival products coming out soon after.” And clearly, that’s a very real danger here. Though, to be fair, there are other possible explanations. It could simply be responsible production scheduling. It might also be that Palm’s financial situation has forced the company to temper its launch run-rate in order to retain adequate capital for marketing and customer service. Or it could be that Pre really is the blockbuster device Palm (PALM) and Sprint (S) believe it to be and no amount of supply will be enough to meet the initial and overwhelming demand for it. It could be that the Pre is the next Apple (AAPL) iPhone.</p>
<p>&#8220;What the iPhone has shown is that if you really do have a compelling device that is revolutionary then customers will switch to your service,&#8221; said Hesse. &#8220;We think the Palm Pre stacks up very well against the iPhone.” </p>
<p>We’ll find out come June 6.</p>

I posed that question jokingly earlier this morning, but turns out there&#8217;s a very real and ugly answer to it: </p>
<p>Not Seagate (STX).</p>
<p>Not Logitech (LOGI).</p>
<p>Not Cisco (CSCO).</p>
<p><a href="http://news.cnet.com/8301-17938_105-9971000-1.html?tag=mncol;txt">Not Philips.</a></p>
<p><a href="http://news.cnet.com/8301-17938_105-10104399-1.html?tag=mncol">Not Yahoo</a>. <a href="http://digitaldaily.allthingsd.com/category/yahoo/">Obviously</a>.</p>
<p>And not Sanyo, either.</p>
<p>All six companies have abandoned plans to exhibit on the Consumer Electronics Show floor. Like Belkin, they are all opting for the more intimate and inexpensive floorspace of a Vegas hotel room. Said Seagate spokesperson Woody Monroy, &#8220;We haven&#8217;t pulled out of CES&#8230;we&#8217;re just taking a different approach.&#8221; Cisco offered this statement on the matter:</p>
<blockquote><p>On our Q1 FY &#8216;09 earnings call on November 5 we announced that we will be reducing expenses for FY09 by over $1B from our annualized expense run rate, given the challenging macroeconomic environment. We are targeting reductions in travel and discretionary-related expenses, including offsite meetings, outside services, equipment, events, trade shows, prototypes, marketing and other activities. Given this focus on reducing costs, we are modifying our participation in the Consumer Electronics Show in Las Vegas in January 2009.  </p>
<p>We have several speakers presenting in the various CES sessions, and Cisco chairman and CEO John Chambers will be delivering a keynote at the conference, as well. We are focusing our CES presence on our direct customers, press and analysts in order to create a more intimate event and reduce expenses. We look forward to an exciting CES 2009 with multiple product announcements that will reinforce Cisco’s consumer strategy. We remain committed to the consumer market, and we believe our cost control focus at this time is appropriate. In support of our CES presence, we will be utilizing Cisco’s world-class Web 2.0 collaboration technologies, such as TelePresence and WebEx, to maintain essential customer and partner communication. Cisco will have compelling demonstration areas and meeting rooms in the Venetian hotel in Las Vegas as we have for the past several years.&#8221;</p></blockquote>

With registration down by 20 percent over last year, there are likely to be far fewer attendees at the annual marquee Apple (AAPL) event, and with a growing list of companies pulling out of the show, there&#8217;ll be fewer booths for them to crowd. Earlier this week, Adobe (ADBE) said <a href="http://www.macworld.com/article/137244/2008/12/adobeexpo.html">it had decided against exhibiting on the show floor</a>. And now <a href="http://www.appleinsider.com/articles/08/12/04/more_big_names_downsizing_pulling_out_of_macworld_expo.html">a coterie of other companies is joining it</a>, top among them, Belkin, long one of Macworld&#8217;s largest exhibitors.</p>
<p>Belkin has confirmed that it&#8217;s pulling its booth from the show floor as well. The company has opted instead to hold private meetings with its channel partners. It insists that this isn&#8217;t so much a financial decision, as a strategic one&#8211;&#8221;we&#8217;re reallocating show floor funds to hold private product meetings,&#8221; a spokesperson told me&#8211;but it&#8217;s hard not to view it that way, given the continued deterioration of the economy. Interesting to note, though, that sources tell AppleInsider that the company had already paid for its 2009 booth space.</p>
<p>Show organizer IDG must be offering Econalypse refunds&#8230;.</p>
<p><strong>UPDATE:</strong> Belkin won&#8217;t be exhibiting at the Consumer Electronics Show, either. &#8220;No booth at CES&#8211;and it&#8217;s for the same reasons why we&#8217;re not exhibiting at MacWorld,&#8221; a spokesperson tells me. &#8220;We learned that a smaller group of our channel partners will be attending CES, and those who are attending are focusing on driving incremental value in 2009. We believe that private meetings in hotel suites are more conducive for this type of discussion, as they are more intimate. So, we are redistributing our resources and funds to help support sell-thru for our retail partners and drive traffic into their stores. Examples: more holiday promotions and programs.&#8221;</p>
<p>As of this morning, no participants&#8211;potential or otherwise&#8211;have pulled out of Super Bowl XLIII, but the trend is looking grim for seasonal blockbusters. We&#8217;ll keep you posted.</p>
