Psystar’s ill-starred crusade against Apple has ended in a total rout. U.S. District Court Judge William Alsup on Friday dropped the hammer on the Mac clone maker, granting Apple’s request for a summary judgment and denying Psystar’s counterclaim.
Interesting turn of events in the Apple-Psystar spat. The unauthorized Mac clone maker has filed for bankruptcy. Seems Psystar’s acrimonious legal battle with Apple and the souring economy have had a deleterious effect on its finances.
Score one for Psystar. The unauthorized Mac clone maker has won the right to continue its countersuit against Apple. In an order signed last Friday, U.S. District Court Judge William Alsup ruled that Psystar–whose antitrust complaint against Apple was tentatively dismissed last year–can refocus that complaint around copyright misuse.
In its last legal salvo against Psystar, Apple suggested the Mac clone maker was backed by a silent third party or two. And at this point it better be, because there’s going to be hell to pay when Apple legal is through with it, regardless of how Psystar revises its original complaint.
Psystar’s ideological crusade against Apple is fast turning into a boondoggle for the Mac clone maker. On Tuesday, a federal judge dismissed Psystar’s antitrust lawsuit against Apple and with it, one of the company’s last remaining chances to stay in business peddling PCs with Apple’s Mac OS X Leopard preinstalled, an apparent violation of Apple’s software license agreement.

By injecting nuclei from mice frozen for 16 years directly into unfertilized mice eggs, a team of Japanese geneticists was able to create healthy clones of the dead animals.
Apple legal has some interesting weekend reading ahead of it. Mac clone maker Psystar filed its 54-page countersuit against Apple late Thursday and, as expected, it accuses the company of restraint of trade, unfair competition, and other violations of antitrust law.
