			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/windows_xp_tomato.jpg" alt="windows_xp_tomato" title="windows_xp_tomato" width="120" height="145" class="alignright size-full wp-image-29283" />Well, this is ironic: Microsoft has been found guilty of violating intellectual property rights in a nation where <a href="http://global.bsa.org/idcglobalstudy2007/studies/2007_global_piracy_study.pdf">82 percent of all software is pirated</a>, a nation that is home to a counterfeiting syndicate that in 2007 was busted for <a href="http://www.microsoft.com/presspass/press/2007/jul07/07-24CounterfeitingSyndicatePR.mspx">manufacturing and distributing more than $2 billion worth of counterfeit Microsoft software</a>.</p>
<p>A Chinese court has ordered the software giant to <a href="http://www.chinadaily.com.cn/bizchina/2009-11/18/content_8992823.htm">stop producing and selling versions of its Windows OS</a> that include Chinese fonts developed by a local software company. Microsoft’s (MSFT) use of two Chinese fonts developed by Zhongyi Electronic, a Beijing-based software company, was not covered by the licensing agreement between the two, <a href="http://english.cctv.com/program/bizchina/20091117/102812.shtml">the court found</a>, and therefore infringed on Zhongyi’s rights. And so Microsoft must pull from the shelves Chinese language editions of Windows 98, Windows 2000, Windows XP and Windows Server 2003.</p>
<p>&#8220;By winning this case against an internationally well-known company like Microsoft, it shows that China, although still a developing country, is taking positive steps to protect intellectual property rights,&#8221; <a href="http://www.reuters.com/article/ousiv/idUSTRE5AH0M020091118?pageNumber=2&amp;virtualBrandChannel=0">an attorney for Zhongyi Electronic told Reuters</a>.</p>
<p>Microsoft, for its part, insists its agreement with Zhongyi covered its use of the fonts at issue and plans to appeal the decision. &#8220;Microsoft respects intellectual property rights,&#8221; the company said in a statement. &#8220;We use third party IPs only when we have a legitimate right to do so.&#8221;</p>
<p>And if Microsoft should fail in its appeal? Well, piracy is so rampant in China, a court order preventing the company from selling certain versions of Windows isn&#8217;t exactly going to hamstring Microsoft&#8217;s business. &#8220;The majority of operating systems in the market today are illegal copies, and the ones that are Zhongyi-related have an even smaller share of the market,&#8221; Analysys International analyst Edward Yu explains. &#8220;So I don’t think it will have much impact on Microsoft’s business.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/11/dellephone.jpg" alt="dellephone" title="dellephone" width="200" height="200" class="alignright size-full wp-image-28941" />After nearly three years of rumor and speculation, <a href="http://content.dell.com/us/en/corp/d/press-releases/2009-11-13-dell-confirms-smart-phone-plans.aspx?c=us&amp;l=en&amp;s=gen">Dell is finally entering the smartphone market</a>&#8211;in China and Brazil. Later this month, China Mobile and Brazil’s Claro will begin selling the company’s Mini 3, a handset designed around Google&#8217;s (GOOG) Android mobile operating system. </p>
<p>Why China and Brazil? Well, for one thing, they are developing markets. For another, Dell (DELL) already has partners there. </p>
<p>&#8220;Besides size (China Mobile has over 500 million subscribers, and Claro serves more than 42 million), we have existing telecom partnerships with them,&#8221; Dell blogger Lionel Menchaca said in a post. &#8220;Back in April, we were the first to embed China Mobile’s technology into our Mini 10 netbook. And if you’ve been watching, you know Dell has agreements with lots of other providers like Vodafone in Europe, Australia and New Zealand. We’ve partnered with AT&#038;T and Verizon in the United States to offer mobile broadband on different products, and we have agreements with other carriers in Asia.&#8221;</p>
<p>Interesting. Presumably this means we’ll see the Mini rolled out in short order in these other countries as well. As you may recall, <a href="http://digitaldaily.allthingsd.com/20091007/dellephone-headed-to-att/">Dell was rumored to be building an Android handset for AT&#038;T (T) in early October</a>.</p>

Hewlett-Packard (HPQ) said Thursday said it would acquire networking gear outfit 3Com (COMS) for $2.7 billion, or $7.90 a share. </p>
<p>The acquisition, which has been approved by both companies&#8217; boards, should bolster HP’s data center strategy and, thanks to 3Com&#8217;s routing business, intensify competition with rival Cisco (CSCO), which has lately been expanding into HP&#8217;s businesses.</p>
<p>&#8220;Companies are looking for ways to break free from the business limitations imposed by a networking paradigm that has been dominated by a single vendor,&#8221; <a href="http://www.hp.com/hpinfo/newsroom/press/2009/091111xa.html">Dave Donatelli, executive vice president and general manager, Enterprise Servers and Networking, HP, said in a statement</a>. </p>
<p>&#8220;By acquiring 3Com,&#8221; Donatelli added, &#8220;we are accelerating the execution of our Converged Infrastructure strategy and bringing disruptive change to the networking industry. By combining HP ProCurve offerings with 3Com’s extensive set of solutions, we will enable customers to build a next-generation network infrastructure that supports customer needs from the edge of the network to the heart of the data center.&#8221;</p>

<p>HP and 3Com Corporation (NASDAQ: COMS) (&#8221;3Com&#8221;) today announced that they have entered into a definitive agreement under which HP will purchase 3Com, a leading provider of networking switching, routing and security solutions, at a price of $7.90 per share in cash or an enterprise value of approximately $2.7 billion. The terms of the transaction have been approved by the HP and 3Com boards of directors.</p>
<p>This combination will transform the networking industry and underscore HP’s next-generation data center strategy built on the convergence of servers, storage, networking, management, facilities and services. The resulting business outcome will help customers simplify the network, deploy a unique and innovative edge-to-core network fabric for the enterprise and improve IT service delivery capabilities, all delivered with best-in-class price-performance.</p>

<p>The acquisition of 3Com will dramatically expand HP’s Ethernet switching offerings, add routing solutions and significantly strengthen the company’s position in China&#8211;one of the world’s fastest-growing markets&#8211;via the H3C offerings. In addition, the combination will add a large and talented research and development team in China that will drive the acceleration of innovations to HP’s networking solutions.</p>
<p>3Com also brings to HP best-of-breed network security capabilities through its TippingPoint portfolio. For the past four years, TippingPoint has been the leader in Gartner’s &#8220;Magic Quadrant&#8221; in its evaluation of leading network security products. Approximately 30 percent of the Fortune 1000 companies have already deployed TippingPoint intrusion prevention systems.</p>
<p>&#8220;We are confident that we can run our entire global business of 300,000-plus employees, including our next-generation data centers, entirely on the new HP networking solutions,&#8221; said Randy Mott, executive vice president and chief information officer, HP. &#8220;Based on our experience and extensive testing of 3Com’s products, we are planning to undertake a global rollout within HP as soon as possible after the completion of the acquisition.&#8221;</p>
<p>Under the terms of the merger agreement, 3Com stockholders will receive $7.90 for each share of 3Com common stock that they hold at the closing of the merger. The acquisition is subject to customary closing conditions, including the receipt of domestic and foreign regulatory approvals and the approval of 3Com’s stockholders. The transaction is expected to close in the first half of calendar 2010.</p>
<p>HP anticipates that the transaction will be slightly dilutive to fiscal 2010 non-GAAP earnings.

Odd then to learn that it is not the most profitable. And odder still to learn that that honor belongs to Apple, which has been in the handset market for just two years. </p>
<p><a href="http://strategyanalytics.com/default.aspx?mod=ReportAbstractViewer&amp;a0=5118">According to Strategy Analytics</a>, Apple’s third-quarter iPhone operating profit was $1.6 billion, while Nokia’s was $1.1 billion. Driving Apple’s profits: Strong sales, high wholesale prices and tight cost controls.</p>
<p>&#8220;We have identified at least 4 key factors underlying Apple’s success,&#8221; Strategy Analytics analyst Alexander Spektor explains. &#8220;First, Apple created a simple sub-brand&#8211;the iPhone&#8211;which was memorable and easy to remember. Second, the firm developed an attractive family of models with standout usability that enabled Apple to charge way-above-average prices to operators and consumers. Third, Apple distributed and co-marketed its handsets through top-tier carriers in numerous high-value countries. And fourth, the vendor has kept a solid grip on production costs by working with Foxconn, the world’s largest contract handset manufacturer.”</p>
<p>Quite an achievement for Apple (AAPL) and a major humiliation for Nokia (NOK), which has seen its dominance eroded by the likes of Apple and Research in Motion (RIMM), and not just in North America, but in Europe. Indeed, in its latest quarter <a href="http://digitaldaily.allthingsd.com/20091015/nokia-earns/">Nokia’s smart-phone market share dropped by six points</a>. </p>
<p>As Strategy Analytics analyst Neil Mawston noted at the time, &#8220;[Nokia has] no iPhone killer to drive a major revival in its smartphone volumes. [It] is still struggling in the U.S. smartphone market, and with competition intensifying in China as well, Nokia’s battles can only get tougher in 2010.&#8221;</p>

<p>Big news often comes in small packages and BoomTown was all over the little moves that meant big stories this week. Kara covered a massive <a href="http://kara.allthingsd.com/20091103/clutter-free-twittified-binged-and-also-apple-icious-the-new-msn-homepage-debuts-plus-screenshots-and-the-press-release/">redesign of Microsoft&#8217;s MSN homepage</a> that follows the old car-racing-mantra-turned-Web-design ethos: Add power and lightness. Everyone breathed a sigh of relief when BoomTown covered the <a href="http://kara.allthingsd.com/20091104/i-love-the-smell-of-settlement-in-the-morning-skype-founders-set-to-get-10-percent-option-to-buy-three-percent-more-and-two-board-seats/">end of the Skype ruckus</a>. All is forgiven, and all it took was a sizable stake in the company and seats on the board. Kara rounded things out by running a quick post about a spankin’ new feature from <strong>AllThingsD</strong>: Every Friday, the just launched <a href="http://kara.allthingsd.com/20091106/meet-drake-meeting-brizzly-a-spanking-new-atd-feature/">&#8220;Almost Famous&#8221;</a> will cover interesting start-ups through the eyes of their chief geeks. Kara’s all about geek love. </p>
<p>Digital Daily isn’t usually big into bean-counting, but this week the numbers were where it was happening. The <a href="http://digitaldaily.allthingsd.com/20091103/chinese-iphone-sales/">first sales figures came back from Apple’s iPhone launch in China</a>, and the numbers weren’t good. As of pub time for the post, only 5,000 iPhones had been (legitimately) purchased. If the Chinese numbers were a picture of modesty, the App Store’s numbers were parading through Time Square in an orange jumpsuit singing Eddie Grant’s &#8220;Electric Avenue.” The two-year-old App store’s epic popularity has pushed its already outsized download numbers past the <a href="http://digitaldaily.allthingsd.com/20091104/apples-app-store-hits-100000-apps/">two-billion mark</a>. Not to be outdone with unprecedented flash, Google (GOOG) violated its own nonrule late in the week and ran a <a href="http://digitaldaily.allthingsd.com/20091106/droid-goog/">semi-ad on the Google homepage</a>. You say ad, they say synergy, but at the end of the day it was a direct promo for Motorola&#8217;s (MOT) new Droid, which runs on Google’s Android platform. </p>
<p>MediaMemo started the week off right with a fresh bite from Apple (AAPL). Peter covered the <a href="http://mediamemo.allthingsd.com/20091102/apples-itunes-pitch-tv-for-30-a-month/">revamp of Apple TV</a>, which will now be offered for $30 a month. <a href="http://mediamemo.allthingsd.com/20091104/news-corp-delivers-inline-revenues-and-an-earnings-bump/">News from News Corp.</a> was no surprise this week, when MediaMemo brought us the story that the media empire (and <strong>AllThingsD</strong>’s uber-parent company) was doing fine as long as you only pay attention to cable and movies. Broadcast and print? Eh, not so much. Finally, Peter asked a few probing questions of Google CEO Eric Schmidt in regard to his company&#8217;s <a href="http://mediamemo.allthingsd.com/20091105/does-your-mom-edit-your-blog-google-wants-to-know/">suspicious addition of a &#8220;blog&#8221; tag attached to some Google News postings.</a> Schmidt speculated, but the ultimate answer wasn’t, as he suggested, because of your mother.</p>
<p>Deep in his Personal Technology bunker, at an undisclosed location somewhere in rural Maryland, Walt got to take a crack at the <a href="http://ptech.allthingsd.com/20091104/motorolas-droid-is-smart-success-for-verizon-users/">new Motorola Droid</a> this week, and his response was, well, very positive. He praised the Droid’s exceptional battery life and call clarity, even if the touchscreen wasn’t quite up to the iPhone bar. All in all, he said it was a win for Verizon (VZ) and the Google&#8217;s mobile OS.</p>
<p><a href="http://mailbox.allthingsd.com/20091104/windows-live-email-tablets-and-vista/">Mossberg’s Mailbox</a> continues to fill with questions about the speculative Apple tablet. Walt offered some other sage advice about making the Windows 7 switch with 64 bits, and what to do with all that grief over the death of Microsoft’s (MSFT) Outlook Express.</p>
<p>Katie was sweatin’ to the newbies this week, with an <a href="http://solution.allthingsd.com/20091103/fitbit-sees-how-you-run-walk-and-sleep/">energetic review of Fitbit</a>, a wireless fob for tracking calories and exercise stats. The Bluetooth headset-sized clip attaches to your waistband and uploads your activities to the Fitbit Web interface, where you can track how many calories you did or didn’t burn. You can also add water consumed and calories eaten. The Fitbit has been shipping since September, but won&#8217;t appear on retail shelves until after the holidays. No word yet on if it will include a &#8220;Cheesecake Factory&#8221; tab to the interface so as to allow for calorie counts that require exponents. </p>

<p>There is &#8220;no sign of the sort of sellout reception that greeted the smart phone at its introduction in other countries,&#8221; The Wall Street Journal reported, adding that there were no lines for the iPhone at the Apple store in Beijing, the company&#8217;s only location in China. </p>
<p>Sounds like a lackluster launch, and with Apple (AAPL) and China Unicom, the only carrier authorized to sell the device in the country, declining to disclose sales figures, it’s difficult to argue that it was otherwise. It clearly wasn’t the rousing success to which we’ve become accustomed. That said, it probably wasn’t quite the bust it’s been made out to be, either. </p>
<p>Why? Well, consider this: <a href="http://iphonasia.com/?p=7795">There were launch ceremonies in 30 provinces</a>. To date, we’ve heard anecdotal reports from&#8211;as best I can tell&#8211;<a href="http://online.wsj.com/article/SB10001424052748703294004574509181789222564.html">one of them</a>. And while it’s admittedly concerning to learn that a China Unicom store in Beijing sold just 10 iPhones last Saturday, that’s just one store. The device was on sale in many, many others (1000, according to Apple COO Tim Cook) across 30 provinces and <a href="http://english.people.com.cn/90001/90778/90860/6799829.html">285 Chinese cities</a> in a nation with 710 million mobile-phone subscribers.  </p>
<p>Finally, while it’s true that the prices Apple and China Unicom are charging for the iPhone are heady, they’re not quite as bad as we’ve been led to believe. &#8220;I think the western media has misconstrued the iPhone pricing in China,&#8221; <a href="http://iphonasia.com/">Dan Butterfield, editor of iPhonAsia told me</a>. </p>
<p>“Nine out of 10 reports that I&#8217;ve seen have simply repeated the &#8216;too expensive&#8217; mantra,&#8221; Butterfield explained. &#8220;They then quote the contract free price point&#8211;4,999 yuan ($730) to 6,999 yuan ($1,025) for the iPhone 3GS. They argue that you can buy a gray-market iPhone cheaper and it has WiFi&#8230;.The truth&#8230;the gray-market price is marginally cheaper for those who want to go &#8216;prepaid.&#8217; But when you examine the full matrix of China Unicom price/plans, you quickly realize that you can save big by going on contract vs. prepaid (pay as you go). There are even four price/plans where your iPhone if free. The iPhone subsidy increases for those who opt for more expensive monthly plans.&#8221;</p>
<p>Butterfield elaborates: &#8220;Moreover, if you want to access &#8216;3G,&#8217; there is no good carrier option other than China Unicom. You can run at 2G speeds on China Mobile or China Telecom. But neither of these two networks support the chipset in iPhone. China Mobile runs TDSCDMA 3G and China Telecom runs CDMA2000 3G. So you are left with China Unicom&#8217;s WCDMA 3G&#8211;a world-standard 3G protocol fully supported by iPhone 3G/3GS. Why not go on contract and get a subsidized iPhone that is well below the &#8216;too expensive&#8217; (contract free) prices that the media is shouting about?”</p>
<p>And in the end, does it even matter? As Butterfield noted, an iPhone sale is an iPhone sale&#8211;whether it’s made by a gray-market vendor or an authorized one. And either way, it&#8217;s good for Apple.</p>
<p>So was the iPhone’s launch in China really a bust? &#8220;Probably not,&#8221; said Butterfield. &#8220;Was it a rousing success? Probably not. The truth is somewhere in the middle.&#8221;</p>

<p>BoomTown’s week began onstage in front of thousands of chanting women. No, Kara wasn’t filling in for Oprah; she was doing something much cooler. She got snagged to moderate a panel entitled &#8220;Changing the World Through the Web&#8221; at Maria Shriver’s <a href="http://kara.allthingsd.com/20091028/changing-the-world-through-the-web-video-interviews-with-zuckerberg-kutcher-shah-and-rospars/">six-year-strong Women’s Conference</a>. Kara&#8217;s panel included a group of VIPs from Facebook, Kiva, Blue State Digital&#8211;and the Twitterific Ashton Kutcher. With &#8220;Mission: Kutcher&#8221; accomplished, Kara followed up with the <a href="http://kara.allthingsd.com/20091028/its-complicated-but-microhoo-also-hasnt-fallen-and-will-get-up/">complicated world of MicroHoo</a> and offered analysis on the <em>still</em>-pending search deal. Moral of the story: Commentators should give it time, and Carol Bartz should quit with the Jerry Yang jabs. BoomTown rounded out the week at <a href="http://kara.allthingsd.com/20091029/kara-visits-tedmed-featuring-synthetic-skin-and-heart-scanning-iphones/">TEDMED</a>. The conference covered the scalpel’s edge of med tech. And yes, in case you were wondering, synthetic skin feels gross. </p>
<p>Digital Daily covered the real-time search war early in the week when <a href="http://digitaldaily.allthingsd.com/20091026/twitter-bing-google-jeffries/">Microsoft’s Bing search folks announced a nonexclusive deal with Twitter</a> to feed on its data stream. The deal did put Bing out front for once, but no one knows if the new info source will turn into profits for either search group.  In a post foreshadowing a grisly murder, John reported results from a ChangeWave research study that placed the <a href="http://digitaldaily.allthingsd.com/20091027/changewave/">iPhone within striking distance of overtaking the Blackberry</a> from Research in Motion (RIMM) in the smart-phone market. Okay, maybe it wasn’t that grisly, but it&#8217;s Halloween. Digital Daily rounded out the week by adding the iPhone to the pantheon of cat, dragon, rat and rooster that occupies the rim of your Chinese restaurant placemat. Apple&#8217;s (AAPL) <a href="http://digitaldaily.allthingsd.com/20091030/iphone-china/">iPhone officially made it to China this week</a>, though without its signature Wi-Fi, and at a much heftier price point.</p>
<p>Peter Kafka lives at the crossroads of media and tech, and that’s exactly where he was almost run down by the <a href="http://mediamemo.allthingsd.com/20091026/microsoft-bails-out-of-family-guy-windows-7-episode-after-actually-watching-family-guy/">Windows 7 &#8220;Family Guy&#8221; episode</a>. Microsoft (MSFT) apparently bailed out of the deal when it took a closer look at what was actually inside. From the “not so fast” files, Peter covered a report from <a href="http://mediamemo.allthingsd.com/20091028/whoops-are-reports-of-the-ad-recovery-greatly-exaggerated/">Interpublic Group</a> (IPG) noting that ad revenue isn’t quite as sunny as some have suggested. Grim economic times caught up to AllThingsD’s big brother late in the week when <a href="http://mediamemo.allthingsd.com/20091029/layoffs-come-to-the-wall-street-journal-too-boston-bureau-closing/">The Wall Street Journal closed its Boston bureau</a>. The move resulted in nine job losses, despite significant resources being poured into the paper by parent News Corp. (NWS). </p>
<p>The leaves are changing color over at Personal Technology, and Walt sensed that chill in the air meant it was time for his <a href="http://ptech.allthingsd.com/20091028/operating-systems-offer-new-choices-in-pc-shopping/">annual fall computer-buying guide</a>. Operating-system choice was a big discussion; but he also touched on the latest must-haves in the memory, graphics, processor and form-factor categories. With a cup of Earl Grey tea to fend off the autumn chill, Walt trudged out to <a href="http://mailbox.allthingsd.com/20091028/running-windows-programs-on-macs/">Mossberg&#8217;s Mailbox</a> this week and came back with a fistful of letters. He dutifully replied to a question about migrating Microsoft files to a Mac running windows, offered clarification on the Windows 7 upgrade process, and weighed in on the rumor of a pending Apple device below a laptop but above an iPhone. </p>
<p>Katie finished it all off with a<a href="http://solution.allthingsd.com/20091027/netbooks-that-are-easier-on-the-eye/"> deep dive on the two latest netbooks</a>. The HP (HP) Mini 31 and the Nokia (NOK) Booklet 3G both offer high style compared with their competitors, and each boast much higher screen resolutions than previous models. Though she came down on the side of the Nokia, Katie remarked that neither option would disappoint. </p>
<p>Bundle up as you head out for tricking and treating, and learn from Weekend Update’s mistakes. Remember to check and make sure that scary face is actually a mask before you bring that new friend home. </p>

ChinaNews.com found about 300 people queued up to buy the device at China Unicom&#8217;s flagship store in Beijing. That’s far fewer than you’d find at an Apple (AAPL) launch event in the U.S., but as I&#8217;ve noted, the Chinese version of the iPhone is quite spendy, with prices ranging from 4,999 yuan ($730) and 6,999 yuan (about $1,025). </p>
<p>In any event, <a href="http://blogs.wsj.com/digits/2009/10/30/beijings-chant-iphone-iphone/">those higher prices and the device’s lack of built-in Wi-Fi</a> don’t seem to be as much of a barrier as you might think. And if those issues do end up tempering sales a bit, well, perhaps China Unicom can make them up by poaching iPhone users from rival China Mobile. As iPhonAsia&#8217;s Dan Butterfield reported earlier this week, China Unicom is offering an amnesty to users of gray-market iPhones. </p>
<p>&#8220;This amnesty program is designed to entice some 1.5 million grey-market iPhone owners in China to sign a contract and pop in a Unicom 3G sim card to take advantage of WCDMA 3G speeds and a variety of new &#8216;Wo&#8217; 3G services,&#8221; <a href="http://iphonasia.com/?p=7510">Butterfield writes</a>. &#8220;The &#8216;upgrade to 3G&#8217; program is no doubt aimed squarely at the approximate 1,000,000+ iPhones now running on China Mobile’s EDGE 2G network.&#8221;</p>

Shares in the company spiked more than $12, or more than six percent, to $202 in early trading Tuesday as investors celebrated <a href="http://digitaldaily.allthingsd.com/20091019/apple-beats-street/">another of the company&#8217;s great quarters</a>.</p>
<p>&#8220;We are very impressed by Apple’s ability to post a record profit quarter during difficult macro spending conditions,&#8221; Canaccord Adams analyst Peter Misek said in a note to clients this morning. &#8220;A host of new product introductions and continued traction with the iPhone give us confidence in the sustainability of Apple’s operating model.&#8221;</p>
<p>Suffice it to say, Misek wasn’t the only the analyst lauding Apple’s (AAPL) fourth-quarter performance. Below a selection of commentary from other Apple watchers:</p>
<p><strong>Gene Munster, Piper Jaffray</strong><br />
&#8220;September results were strong despite headwinds of iPhone production constraints and a Mac desktop offering in need of a refresh. We expect these headwinds to become tailwinds in the December quarter, which we believe will be positive for AAPL shares in the coming months.&#8221;</p>
<p> <strong>Mike Abramsky, RBC Capital Markets</strong><br />
&#8220;With strong financial performance and product uptake amidst recession, and further catalysts (iPhone in China, Tablet, refreshed iMacs, iPhone share gains/momentum), we foresee further upside for the shares.&#8221;</p>
<p><strong>Maynard Um, UBS</strong><br />
&#8220;Upside to virtually every metric in the qtr backs our positive view on Apple. We continue expect greater &#8220;recurring&#8221; iPhone hardware revenue (growing installed base &#038; stickiness of the App Store), which should drive more visibility into iPhone sales (20%+ of our FY10 iPhone shipments), as well as iPhone expansion driven by new partnerships (&#038; end of exclusivities). Longer term, we believe a service to provide seamless access &#038; mobility of digital content across all products may be the draw (halo) that drives additional future Apple product sales.&#8221;</p>
<p><strong>Tavis McCourt, Morgan Keegan</strong><br />
&#8220;Overall, Q4:09 was a strong quarter for Apple, as the Mac is nearly becoming the de facto computer for the back-to-school season. Additionally, iPhone trends remain remarkably strong, with unit economics holding up at unheard of levels in the wireless industry.&#8221;</p>
<p><strong>Yair Rainer, Oppenheimer</strong><br />
&#8220;As usual, Apple appears to be leaving plenty of room for upside surprises to both revenue and margins. On the revenue side, Apple should benefit from continued Mac momentum (particularly in Europe), higher recognized iPhone revenue, and some channel fill for both Mac and iPhone. Gross margin upside is likely to come from a higher proportion of recognized, high-margin iPhone revenue.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/10/steve_moneybags.jpg" alt="steve_moneybags" title="steve_moneybags" width="350" height="233" class="aligncenter size-full wp-image-26894" />Apple’s September quarter saw, among other things, the release of <a href="http://digitaldaily.allthingsd.com/tag/snow-leopard/">Snow Leopard</a>, the latest upgrade to its OS X operating system and <a href="http://digitaldaily.allthingsd.com/20090909/live-from-apples-lets-rock-event-10-am-pdt/">the first public appearance of CEO Steve Jobs</a>, who’d been on a medical leave of absence for a liver transplant. It was also the first full period since the company launched the iPhone 3GS, in late June. </p>
<p>No wonder it was a blowout quarter.</p>
<p>After market close Monday, <a href="http://www.apple.com/pr/library/2009/10/19results.html">Apple reported a fiscal fourth-quarter profit of $1.67 billion</a>, or $1.82 a share, on revenue of $9.87 billion. That topped the estimates of analysts surveyed by Thomson Reuters, who&#8217;d expected the company to earn $1.42 a share on revenue of $9.2 billion.</p>
<p>The company sold 3.05 million Macs during the quarter, a 17 percent increase over last year. It sold 10.2 million iPods, an eight percent decline from the year-ago quarter. </p>
<p>And iPhones? Apple (AAPL) sold 7.4 million of those&#8211;seven percent more than during the same period last year. So much for those <a href="http://digitaldaily.allthingsd.com/20091016/apple-earns-iphone-supply/">supply-chain issues that some analysts warned might undermine iPhone sales</a>.</p>
<p>&#8220;We are thrilled to have sold more Macs and iPhones than in any previous quarter,&#8221; said CEO Jobs. <em>&#8220;We’ve got a very strong lineup for the holiday season and some really great new products in the pipeline for 2010.&#8221;</em> [Editor's Note: "...really great new products"--is that code for a tablet?]</p>
<p>Apple shares, which closed at $189.86 today, are spiking as I write this. At $203.90, they&#8217;re up more than seven percent in extended trading.</p>
<p>Looking ahead to its fiscal first quarter, Apple estimates it will earn between $1.70 and $1.78 a share on revenue in a range of $11.3 billion to $11.6 billion. That’s comically lower than the $1.91 a share on $11.45 billion in sales that analysts are forecasting. But as today’s results clearly demonstrate, Apple subscribes to the underpromise-and-over-deliver school of guidance theory, so there’s likely little cause for concern.</p>
<p>So, to recap: Apple sold more Macs and more iPhones than in any previous quarter in the company’s history. Before the holiday quarter. And in midst of the worst economy we’ve seen in 50 years.</p>
<p><b>Notes From the Earnings Call:</b></p>
<ul>
<li>Apple COO Tim Cook and CFO Peter Oppenheimer are handling the earnings call. CEO Steve Jobs will not be attending.</li>
<li>Oppenheimer says this was Apple’s second-highest quarterly revenue ever. Highest-ever operating margin. &#8220;We are thrilled with these record-breaking results, particularly given the economic environment around us.&#8221; <em>Obviously</em>.</li>
<li> Macs are showing &#8220;fantastic momentum,&#8221; says Oppenheimer. Sales have outpaced the market in 19 of the past 20 quarters. Quarterly sales were up 17 percent; portable sales, 35 percent. Interesting: 42 percent growth in Asia.</li>
<li>Moving on to iPods: Sales were down to 10.2 million from 11 million a year ago. But iPod touch sales doubled. MP3 market share in the U.S. is now more than 70 percent (according to NPD, I think).</li>
<li> iPhone sales were up seven percent. Apple will begin selling iPhones in China later this month. More than 85,000 apps in App Store. Two billion downloads.</li>
<li>Apple opened 15 new stores during the quarter. Now has 273. Will soon open first two stores in France, including one at the Louvre.</li>
<li>Moving on to the Q&#038;A. Asked about those iPhone 3GS supply issues I mentioned earlier, Cook acknowledges that demand did outstrip supply in a number of countries. But the situation improved &#8220;markedly&#8221; in September. How are things looking for China? Cook: &#8220;I would have liked to have had more, honestly, because we were still short in some countries at the end of the quarter.&#8221;</li>
<li> Apple is obviously very excited about the iPhone’s impending debut in China. &#8220;There’s a good opportunity, and we’re really excited to get started,&#8221; says Cook. &#8220;It’s the largest market in the world in terms of total phones.&#8221;</li>
<li>No comment on the broader economy. &#8220;We just spend our time projecting our business and leave the economy to the economists.”</li>
<li>Does Apple worry about iPhone rivals? Android? Not really, says Cook. &#8220;We feel very good about suiting up and competing against anyone.&#8221; Our competitors are still trying to catch up with the first iPhone, he adds.</li>
<li>Snow Leopard? Cook says the company&#8217;s been &#8220;pleasantly surprised&#8221; by sales of Apple&#8217;s latest OS.</li>
<li>How does Apple benefit from carrier-exclusivity iPhone deals? Cook says carriers with exclusivity deals are willing to invest more in the platform and that means greater innovation. Visual voicemail is an example of that. That said, he adds, &#8220;We’ve found no lack of people wanting to sell iPhones, frankly.&#8221; </li>
<li> International store revenue up more than 20 percent, on average.</li>
<li> More on iPhone supply issues. Cook insists this is not a component issue, though he notes that silicon can sometimes be hard to get. &#8220;We feel good about our position now.&#8221;</li>
<li>And still more on iPhone supply issues: How many iPhones would Apple have sold if it had an adequate supply? Impossible to say, really, Cook says, adding that 3GS units were in short supply virtually everywhere in September.</li>
<li>Enterprise demand for the iPhone is very strong. It’s either being deployed or already in use at some 50 percent of Fortune 100 companies. Same with Europe and the FT 100. Widely used in higher ed and government as well.</li>
<li>But perhaps not widely enough. Asked about institutional sales,  Cook says Apple isn’t seeing much stimulus funding. The company&#8217;s worried about state spending. Says Cook, &#8220;We may see more this quarter, but it’s too early to tell.&#8221; </li>

On Thursday, the chip maker reported <a href="http://phx.corporate-ir.net/phoenix.zhtml?c=74093&amp;p=irol-newsArticle&amp;ID=1342558&amp;highlight=">a narrower third-quarter loss</a> than projected, thanks to &#8220;strong demand&#8221; for its microprocessors and graphics chips. </p>
<p>Analysts had expected AMD to lose 42 cents a share on revenue of $1.26 billion, according to a consensus survey by Thomson Reuters. Instead, the company lost 18 cents a share on revenue of $1.4 billion, which was down from $1.8 billion for the same quarter last year.</p>
<p>Not the sort of <a href="http://digitaldaily.allthingsd.com/20091013/intel-profit-sales-beat-street/">blow-out quarter we saw from Intel</a> (INTC) earlier this week, but encouraging news nonetheless. Certainly, AMD’s leadership believes the company is poised for a turnaround. During a conference call to discuss AMD&#8217;s (AMD) third-quarter results, CEO Dirk Meyer offered an upbeat outlook for the remainder of 2009 despite the current loss. </p>
<p>&#8220;Third quarter consumer PC demand continued to improve from prior periods, with particular strength in notebooks and in China and continued recovery in Europe and in North America,&#8221; <a href="http://seekingalpha.com/article/166870-advanced-micro-devices-inc-q3-2009-earnings-call-transcript?page=-1">Meyer said</a>. &#8220;And it appears the commercial IT markets are positioned to improve next year&#8230;.Going forward, we believe we are well positioned to succeed.&#8221;</p>

Or it is in Google’s case anyway. </p>
<p>Reporting <a href="http://investor.google.com/releases/2009Q3_google_earnings.html">third-quarter results</a> after market close Thursday, Google (GOOG) topped estimates, posting net income that rose to $1.64 billion, or $5.13 a share, from $1.29 billion, or $4.06 a share in the same period last year. Net revenue for the period ended in September rose nearly one percent to $4.38 billion. Excluding items, earnings for the quarter were $5.89 a share. Consensus estimates had been calling for $5.42 a share and $4.24 billion in net revenue. The chart below shows revenue sources within Google (click to enlarge).</p>

<p>Impressive. Seems paid clicks grew 14 percent compared to the same period last year, and four percent compared to the prior period. Cost per click was down six percent year over year, but up five percent sequentially.</p>
<p>&#8220;Google had a strong quarter&#8211;we saw seven percent year-over-year revenue growth despite the tough economic conditions,&#8221; said CEO Eric Schmidt. &#8220;While there is a lot of uncertainty about the pace of economic recovery, we believe the worst of the recession is behind us and now feel confident about investing heavily in our future.&#8221;</p>
<p>Good to hear. Google’s shares, which have already risen more than 50 percent in the past six months, are on another upward tear. They rose 1.82 percent to $539.27 on the news in after-hours trading.</p>
<p><strong>Earnings call highlights via <a href="http://blogs.wsj.com/digits/2009/10/15/live-blogging-google-earnings-3/">The Wall Street Journal&#8217;s Andrew LaVallee</a>:</strong></p>

<p>4:32: Call starts. The cast is the same as last quarter: <a href="http://www.google.com/intl/en/corporate/execs.html#eric">Mr. Schmidt</a>, CEO; <a href="http://www.google.com/intl/en/corporate/execs.html#pichette">Patrick Pichette</a>, CFO; <a href="http://www.google.com/intl/en/corporate/execs.html#jonathan">Jonathan Rosenberg</a>, SVP of product management; and for the first time, <a href="http://www.google.com/intl/en/corporate/execs.html#nikesh">Nikesh Arora</a>, president of global sales operations and business development. But there&#8217;s a twist&#8211;they&#8217;ll be using Google&#8217;s moderator to vet questions with voters. <p>4:35: &#8220;While there&#8217;s obviously a lot of uncertainty about the pace of the economic recovery, we believe the worst of the recession is behind us,&#8221; Schmidt says.</p>
<p>He adds that Google now has the confidence to invest &#8220;heavily&#8221; in its future. &#8220;It&#8217;s all good news from our perspective, at least in looking at the quarter.&#8221;</p>
<p>4:37: Says &#8220;we want to really get to the perfect search engine&#8221; and that many advertisers would like to spend more with Google if the company&#8217;s product allow them to do that.</p>
<p>4:38: Schmidt says &#8220;we&#8217;re open for business in making strategic acquisitions, both large and small.&#8221;</p>
<p>4:39: It&#8217;s Pichette&#8217;s turn. &#8220;At a high level, we&#8217;re very pleased with our Q3 results,&#8221; he says. The quarter benefited from growth in AdSense for content and display initiatives.</p>
<p>4:41: U.S. revenue up 4% to $2.8 billion. U.K. revenue decline affected by foreign exchange as well as ongoing macroeconomic weakness, Pichette says.</p>
<p>4:42: Operating expenses rose from the prior quarter, mostly due to payroll, equipment and facilities-related expenses. </p>
<p>&#8220;We believe the worst of the recession is behind us,&#8221; he says.</p>
<p>4:44: Brazil was a standout in Latin America, Arora says. We&#8217;re beginning to see signs of recovery in Europe and Africa, particularly Spain. In Asia, China performed strongly as an emerging market.</p>
<p>4:46: Looking at the display-advertising business, those have also shown strong results, he says. </p>
<p>On YouTube, new advertisers and partners are helping with monetization efforts. Ninety percent of the top 50 advertisers have run YouTube campaigns with successful results&#8211;recent examples include McDonald&#8217;s and Hewlett-Packard.</p>
<p>4:47: YouTube has signed deals with all four major record labels and several independent labels. Earlier today, Google announced a partnership with Channel 4 in the U.K., which will bring full-length programming to the video-sharing site.</p>
<p>4:48: Arora adds a personal shout-out to the sales team.</p>
<p>4:50: Rosenberg calls the new AdWords front-end one of the company&#8217;s biggest investments of the year. Advertisers have new reports, can run more efficient campaigns and can get new features faster thanks to the platform, he says.</p>

<p>Dragging the company down: A 908 million euro goodwill write-off in the Nokia Siemens Networks venture it co-owns with Siemens (SI). Revenue was 9.8 billion euros, or about $14.6 billion, which was down about 20 percent compared to last year. Worse, smart-phone market share declined to 35 percent from 41 percent in the previous quarter.</p>
<p>Six points gone in three months? That’s a brutal loss and one that demonstrates just how much pressure the company is seeing from Apple (AAPL) and Research in Motion (RIMM), among others. </p>
<p>&#8220;Nokia is launching plenty of new high-end smartphone models, such as the N900 and N97 mini,&#8221; <a href="http://www.reuters.com/article/businessNews/idUSTRE59C5B120091015?sp=true">Strategy Analytics analyst Neil Mawston told Reuters</a>. &#8220;But as yet there is no iPhone killer to drive a major revival in its smartphone volumes. Nokia is still struggling in the U.S. smartphone market, and with competition intensifying in China as well, Nokia&#8217;s battles can only get tougher in 2010.&#8221;</p>
<p>Still, Nokia (NOK) did have some good news to report. It expects mobile device volumes to increase in the fourth quarter of 2009 and it sees the global handset market shrinking less this year than analysts had feared&#8211;seven percent instead of 10 percent. </p>
<p>&#8220;It is encouraging to see some signs of recovery in our markets,&#8221; Kallasvuo said during a conference call. &#8220;But let&#8217;s be clear, uncertainty in end-consumer demand remains.&#8221;</p>
